I don't get how his buying through his company makes it any easier for me? I have his home address. I doubt the police will have any trouble finding this guy if they want to look into it. I can look at his house through Google Street View. The problem is that my feedback is meagre compared to his company's powerseller status :(

I have a good case and all the evidence is on my side. I'll see how the Paypal claim goes, if it starts going south I will get the police involved.

If he's a good scammer...the shipping address you sent it to probably can't be linked to him.

In the end...if this goes to a police investigation...the key to proving prior ownership of the iPhone would be the ID and serial numbers that you retained. Bottom line....sounds like should the police run this guy down it will come down to proving your original ownership of the iPhone he retained. And if you have purchased the iPhone through Apple or AT&T then you can prove original ownership of the phone.
 
During a Paypal dispute, when the buyer is required to send the original item back to the seller, all PayPal requires is a tracking number and the money if refunded

so the buyer can return a razr phone with a tracking number and will get the money back without PayPal confirming its the original item

That's what I'm understanding. That is unbelievable. If that is the case then it's very easy to to perform this scam. A reverse "bait and switch".

Still...get the police involved if after filing a fraud ticket doesn't get resolve. Should fairly easy in this case to provide some proof to the police that the wrong iPhone was returned...via the serial numbers.

It really really makes me angry to hear about the low life people out there that would rip good people off in such a way. Just sickening.....

appealing it will do nothing. this result was expected.

i haven't been scammed yet but i don't think i'll use eBay anymore for higher priced items.
 
It is the same concept as SJ's claim that only 0.55% of all iPhone 4 users complained about the antenna issue (which is BS given that not everyone has AppleCare), or that 1.7% (51,000) of iPhone 4's have been returned.

Everybody has AppleCare for the first year and phone support for the first 90 days.

AppleCare is the protection plan you buy that extends coverage for up to 2 years. The 90 day phone support, as well as the 1 year limited warranty, is not AppleCare. Do you see the red bars in the graphic? That is AppleCare. The grey bars? NOT AppleCare. SJ during the press conference explicitly stated that the numbers were through AppleCare. Since not everyone signs up for AppleCare, the numbers cannot fully represent the entire population of iPhone 4 users, and hence, is total BS.

We're dealing with semantics here. AppleCare is synonymous with Apple's warranty, whether in its first year or the extended protection in the 2nd year. You're reading too much into it and SJ meant 0.55% of all iPhone 4 users, not just those who purchased the extended protection.

SJ explicitly said AppleCare. Unless he comes out and clarifies that he meant all iPhone users, I'm going to assume he meant just AppleCare. Plain and simple. SJ isn't dumb, he knew exactly what to say up there and how he was going to say it. You can go ahead and assume that you "really knew what he meant" since obviously you must know something that the rest of us don't, right?

AppleCare is NOT synonymous with "limited warranty". I can give you a simple example: The 1-year limited warranty does NOT cover consumables, such as the battery. Guess what? AppleCare does. Still think they're synonymous? Unless you start doing your own research please stop posting crap that isn't true.
 
ebay won't even let you give bad buys negatives anymore. had a fail to pay buyer and even filing that I never got paid nothing shows on her record.
I pretty much sell everything as is no returns.

SJ used the 0.55% figure to show that the antenna problem wasn't a significant one and he isn't stupid enough to be that deceptive. He wouldn't have survived the onslaughter that follows. The vast majority of us interpreted it to mean 0.55% of all iPhone 4 users. Another poster interpreted it as 0.55% of all AppleCare calls. People will believe whatever they want and delude themselves for no good reason, and you're no exception.
 
you know if you sell something like that on ebay just select the option for no returns or refunds........all sales are final kinda deal...ship it and require a signature on delivery and your covered....

That's actually not true. I DID say "No Returns Accepted" but the person filed a PayPal dispute anyway. If you don't accept the return, they get to keep your money AND your item.
 
Good news everyone! Paypal sided in my favour and is refunding me the money. My faith in Paypal has been restored!

This is all not sounding good :(

I have all relevant documentation. I have a photocopy of the warranty documentation with the original serial number, I have copies of the the original serial number, IMEI, model number, etc. Basically I have complete photographic proof that this phone is not mine.

Has any seller ever gotten their money back through the Paypal dispute process? Is it even possible, or do they always side with the buyer?

I did once - sold the person a water damaged macbook and they paid through paypal. Shipped to a confirmed address with signed delivery and everything was fine.

Few weeks later they tried to reverse the payment through their bank. Contacted paypal and showed documentation etc. They reversed the funds back into my account.

It's good to see they sided with you. I learned to follow everything they tell you (require signature delivery etc) and document everything.
 
You obviously have no clue about eBay/PayPal. There are no inconsistencies in his story. The OP sold his 3GS, and now the fraudulent buyer has decided to "return the phone" for a refund. What happens is that the buyer would initiate a claims with PayPal for a misrepresented item. PayPal contacts the seller, telling him that the buyer has requested to return the item. The buyer then ships back the "old 3G" with a tracking number that they would provide to PayPal as proof they shipped it back. PayPal does not care whether they sent a phone or a brick, since they only recognize the tracking number, and once it shows it has been delivered, PayPal would take the money out of your account and return it to the buyer. If you were smart enough to withdraw the funds from your account, your account would have a "negative" balance from the return and if not paid back to PayPal could lead to your account being suspended, maybe even sued if the amount was large enough.

To make sure PayPal itself is not being ripped off because of this, they now have a new policy that they would "hold" the funds for a particular transaction until the buyer has approved the item they bought. Even more problems for the seller, since he potentially can be out both the money and the merchandise.

There is no way to protect yourself from this if you are the seller. You are delusional to think that having videos of you packing, shipping, etc. will help your cause, since they don't prove anything (and more importantly since PayPal won't accept that as evidence). Quite frankly I find it rude and offensive that you called out the OP as him being "in a mess of his making" without knowing all the details, or because you simply are ignorant on how easily a seller on eBay can be ripped off these days.

Exacly pictures and video is not proof. It happened to me, what I did was refuse the package because it was damaged and idiot buyer never insured the package, Finally he said for $100 dollars less then he paid he would keep the package. I used to love ebay now its a joke as a seller.
 
So, you need a working phone to use? What were you going to do after you sent away your 3gs? Obviously you werent really in need of a phone, if you sent your only one away.

Im assuming you were planning on getting a new phone, so why not just do that still? Why are you stuck on this 3g that he sent you?
