I'm in the US and here you can also enter your own terms when a seller accepts Best Offers on their Buy It Now listings. When you click on make offer, there's a little link that says add your note and when you click on that it says "Only use this section if you plan to add clear and detailed contract terms to your offer." So I don't think the OP did anything wrong here. As for the price he wants to get it at... I'm under the impression that the seller paid US dollar price for it. The company is based in the US and the auction says *dispatched in EU so no VAT which also makes me think it wasn't purchased there if there is a need to point that out. So if you take the US total 2500 for a new mbp and convert it, its like 1547 and the seller said 99 for apple care so that is still under what the OP is paying so I don't see how the seller is getting ripped off :confused:

OP: I would just be patient... obviously don't pay anything til you hear back from the seller, but give him at least a day or 2 to respond. If he wants your money he will be in contact :) You're not going to be forced into anything you didn't agree to, so no need to worry!
 
You did do something wrong, it's just not what people are mentioning. You accepted a contract and incorrectly assumed that the seller has to reconfirm the deal with you via messaging system before you pay for the item. There is no requirement for the seller to reconfirm this deal via the messaging system once they accept it. In fact there is no requirement for a seller to send you any messages until you have opened a dispute with them, and you can't do that until they fail to deliver an item that you already paid for.

The terms of the contract are irrelevant if you haven't paid yet because the contract puts the burden on you to pay before anything else is required. You can speculate as to why they aren't responding, but Ebay will likely tell you to pay, then wait and see if you get the item + Applecare arrives. Otherwise the seller can give you an unpaid item on your record, and you can't really do anything about it. Also, you won't win with feedback in this situation because you are asking for something extra: a message confirmation of the deal before you pay. They could get that feedback removed.

next, we exchanged several e-mails, and he was very happy to sell me AC for 99GBP, when i made my original bid..

i then made the counter offer, stipulating my terms of purchase was that my final price includes AC

i stated this in an e-mail and if he was not happy - he should of not accepted!

now hes gone very quiet since i reminded him the terms of the contract - something that was in plane sight when he hit the accept

i did not intend to deceive seller, as stated to death now i mailed him, and the terms where plain and simple

He is selling a USA model, costing him approx 1550GBP, Appecare, as quoted by him 99GBP
so he is at least hitting cost

I am happy to cancel the bid if the seller wants, but he wont respond!

regardless, I don't think you are going to get the AppleCare as it wasn't in the original eBay auction. If you file a dispute because of this, eBay may not look at the messages as part of the "contract". Of course the seller may be nice and include it.

Is the AppleCare a deal breaker? Seems like a decent price w/o the AppleCare.
 
also you state that the seller is at "cost", but you have to realize the fees included. I believe electronics is higher percentage than normal. So he is probably getting hit with a couple hundred in fees..although that was his choice to sell on eBay.

First off I really doubt your 100% feedback rating is at risk considering at least in the US a Seller CANNOT leave a Buyer NEGATIVE feedback ... or even Neutral feedback.

Trust me I know I've sold a ton of items on eBay and a decent amount of them for a significant value as I sell Diamond Jewelry on eBay.

I have significant experience with eBay and am sure that when all is said and done if the seller backs out you will be able to get the transaction cancelled with no negative impact.

I also advise you not to leave a negative feedback or file a paypal case till you have communicated with the seller (or given him a fair chance to respond which would be about 24 hours).

I really hope it works out for you, I have the reverse problem that you do where people have purchased items from me without understanding the terms of the listing (namely either the handling time or the quality of the item) due to lack of reading the thorough descriptions I provide... and then proceeding to cause me problems due to their ignorance to the terms clearly put forth at the sale.

The fact is on eBay the Buyer Reigns supreme and has a strangle hold on the seller.

ebay.co.uk - customer support and paypal confirmed that seller must honour the term of sale, in this case the fact i stipulated that my counter offer included the applecare.. sheeshh >>>>>>>>>>bangs head against brick wall

cool that seller agreed to terms. was wondering how this would turn out.

I still wouldn't want to be the one receiving that package though lol, seller can't be happy about it. Poor box.
