It shouldn't be nicked or scratched. Take it back. The screen looks fine to me but I like a warm toned screen.

You have a damaged item, their return policy has nothing to do with it, you don't have to pay shipping to get a damaged item replaced, with any seller, ever.

If you decided you didn't want it even though there's nothing wrong with it, then yeah you would pay to send it back and they would refund you under their 30 day return policy, but damage to the casing falls under Faulty or Defective goods as far as I'm concerned, and them or apple should swap it out no questions asked, and with no monetary loss to you.

Opened up my new ipad 64 GB with giddiness only to find a silver nick on the top left side of my ipad! A clean 1 mm nick going horizontally from the edge of the silver case. Unbelievable... also not sure if I have a yellow tint or not since I dont have an ipad 2 to compare it with.

I ordered it from bhphotovideo.com, do they accept returns without charging us shipping?

Update:
My screen (is it yellow tinged?)

My nick!

If you are unhappy with your purchase, just return it and try again at the Apple store. Your money, your rights. Why settle for something that you are not happy after paying so much? By the way, I'm either seeing dead pixels or dusts on your screen.

I am not particularly dramatic when it comes to many items I buy. The whole thing with people exchanging a half a dozen iPads because of minuscule or nonexistent display maladies is completely insane.

That said, if I bought a brand new product, opened the box and it had any kind of physical damage, like your nick, I would exchange it. That kind of thing is obvious and shouldn't pass QC. It means that either it wasn't checked at all, wasn't checked thoroughly, and as a result may have other flaws that have yet to make themselves apparent.

Unlike your situation however, I would've bought mine in a store. I don't like exchanging high value items through the mail. It takes time, there are risks, and there are often expenses due to shipping that might be incurred.

Your screen looks fine. The nick is not good, but whether it's worth the hassle for you to exchange it is another question. Realistically, you're going to scratch the case at some point. It won't look perfect forever--probably not even for a month. Is it worth the headache? That's up to you.

That brings me down. :( If I have more bad luck it could cost me heavily.. I guess I dont have a choice but to keep it. Aside from the nick, I think I am good but I am not sure.

Is there a Apple store near? If so, they will exchange it on the spot;)

You were right! ^^
I received a reply from BH. They will return and ship new one for free!

I planned on using a bodyguardz shield to keep it looking new for eternal.

i find it interesting how you worry about such a miniscule nick on your iPad while still sporting all the 'ugly as hell' stickers on your laptop :/

The difference is HE put the stickers on his laptop...ugly or not, he chose to stick them on their. He didn't choose to have a nick on his new iPad. Big difference.

If you don't see any yellow then it's not there. If you need a direct comparison to detect it then it's fine.

Not true. Mine looked ok until I compared it to an iPad 2 or another new iPad, then it was obvious. I swapped it and now it looks perfect next to others.
