You twit, he just took it out of the box and it had scratches. What the hell is a big ugly ass case like that going to do when you freshly unbox an item that came scratched. Read the damn post next time.
 
has light leak on one side. There are a few scuffs/scratches on the silver bezel - right out of the box - should I exchange it or would most of em have the same thing? I am sure they wont open up many new phones just to please me.

I had exactly the same problem with 32GB GS and Apple replaced it - no questions asked, but the replacement had even more scratches... I have graciously accepted refund.
Will keep my original 3G for the time being - still in perfect condition after 12 months of use.

I had the exact same problem with scuffs/scratches on the bezel on my 32gb unlocked 3GS all I did was get a lint free cloth with a tiny bit of screen cleaner sprayed on and ALL the marks went away

You could try that first before taking it back to Apple

Trying to clean it first might save you an unnecessary trip, however, if you're unhappy and you just purchased it, it sounds like you're within the return/exchange period. Bring the phone back in the box with all of the accessories and tell a sales person you wan't an exchange. Show your receipt and you'll be walking out with a new phone in no time. DO NOT go to the genius bar unless you have well exceeded the return period as they will give you a refurb without original packaging.
