I used sand paper on my new case today for the same reason... I rolled the sandpaper up like a cigarette, put it inside the whole... In and out a couple of times ...The sandpaper shaved it down far enough...The whole switch is accessible now... It worked perfectly for me... :D

I found the newer version at a AT&T store today. They charge a extra $5 but at least it fits the 4s.

I've yet to receive a response. Does Incipio require you send them the existing case first? I'd hate to go case-less for however long it takes to process. Because THAT would be the time I drop the phone!

Yea you return the case first
You need to get a RMA number on the site by filling out a return form

I ordered mine from amazon luckily and returns are very easy. Went to the apple store and got a bumper yesterday. very pleased with it so far. also have a magpul case in the mail.

Came out almost perfect..... I started not thinking it would work and it still came out good... The sand paper shaved it down pretty quick... Just did a friend of mines and his looks perfect !! Not hard at all... Took me maybe 2 minutes... I have bumpers from my 4 I'm about to get to next

Hmm. Gonna try that with my Pixelskin HD

Just got my 4S NGP case (Model #IPH-580). Same problem. Other than the mute button cutout, this case is perfect. Here's a pic:

I called customer service and the rep said they were revising the design and their timeline for delivery is about a month. Once they get the new designs in they will ship the replacement free of charge.

Shoot, I just bought mine at Walmart and noticed the mute hole is right up on the switch like int he photo above. I already put the screen protector on - should I return it to Walmart of email Incipio?

Are the volume buttons in the same place even if the newer cutout is bigger? If the new case version is a month out, how do some people have the bigger-hole NGP already?

I think it's the color. Only one I have seen that is correct is black. Everything else if off. Since black is likely the most popular color it would make sense they got them out first.

Again...the buttons are in the EXACT SAME SPOT. Everyone keeps referencing that photo but doesn't realize the 4S (on the left) and the Verizon 4 (on the right) aren't even with each other.

The ONLY difference is the mute switch.

I was referring to the AT&T buttons being higher, not the Verizon being different from the 4S. I know those two are the same. Since the mute hole is in the wrong spot, though, it's clear the case was designed for the AT&T phone, so the volume buttons could be off, as well.

Also, my case is black, so I must have gotten one fo the old ones

Just got back from Walmart with two ngp cases. Picked out a translucent grey one for myself and a turquoise one for my wife. It wasn't till I got home that I realized that mine has the issue with the mute button on my AT&T 4s, and my wife's doesn' (same phone). Upon returning to Walmart, I found that the there is a slight difference in both the packaging and cases.

Old design:

Sticker on package says "for the new iPhone 4"
Cardboard "phone" insert has the apple logo (translucent cases)
Incipio logo on case is wider (like a stamp)
Mute switch cutout is about a wide as my pinky fingernail

New design:

Sticker on package says "For the new iPhone"
No apple logo on cardboard "phone" insert (translucent cases)
Incipio logo on case is narrow (looks "printed")
Mute switch cutout is about as wide as my index fingernail
(cut out almost to the + button)

After some digging I was able to find new and old versions of the few colors they had available. A quick return and I'm now enjoying the new version of this great case with no mute switch issues!

Incipio has two different versions in the same package

Incipio seems to be packaging two different versions of the same case in the same exact package:

A few days ago, I went to my local Walmart and got the NGP for my iPhone 4S based on the great reviews I found on Amazon. I love the case but found that it had the same problem mentioned in this thread where the mute button was rubbing against the bottom part of the cutout. After reading this thread, I went to back to a DIFFERENT Walmart and took a closer look at their stock of NGP cases.

What I found was that they had TWO different versions of the NGP case packaged in the EXACT same package (both had the same artwork, were labeled "for the new iPhone 4", and had the exact same UPC and model number). Upon very close inspection though, you could see that the hole size on some of the cases was slightly different. There was NO way to know which package had which case though by only looking at the UPC or model number (since the packages were EXACTLY the same). Only by looking very closely at the case inside was I able to see the difference. I went back to the first Walmart to see if they also had both types of cases in the same package and sure enough, they did. Two different cases with two different cutout sizes in the EXACT same package.

Bottom line:

It appears that Incipio has changed the design of their case at some point but not changed the package at all.

So if you buy this case online, you will likely have a 50/50 chance of getting the right case since there will be no way of telling which one you will get in advance, based on the model number or sku code.

My advice to anyone else that has gotten an NGP that does not fit their iPhone 4 or 4S is to either go back to the store you bought it (if you can) and see if they have the other version in the same case, or to call Incipio and ask them to send you the latest version.

Got an NGP too, and my mute button looks exactly like above. It's good enough. Just clears the button, but good enough.

Thx! I'm going to Walmart tomorrow!

Went to Walmart yesterday. They had 4 in stock. All of them said "For the new iPhone4", but I did look closely at the cases through the box. All the ones this Walmart had were all the same.

I called incipio this AM and they will send me a replacement. I need to email them a pic of the case and a copy of the receipt and they will send me a replacement w/ the correct mute switch cutout when they are available.

Besides that this case is awesome. White iPhone w/ Smoke NGP looks awesome, especially w/ Lucky Labs Spectras.

For some reason the spectra wrap looks a lot worse in the pic then it does in person. I will be switching it soon though cause I tried a few cases in the last few days that were way too snug and either pushed up my PS screen protectors or pushed on the Spectra wrap.

I just returned from Walmart today and they had one translucent Mercury gray ngp left. I am happy to say the case fits perfectly with no mute switch cutout problems. I had actually bought a black ngp from an AT&T store and it had the switch cutout problem so I has to return it. The case looks great and isn't too thick. The best thing about it was the price. It was only 14.99 at Walmart. It was certainly a pleasant surprise. Especially considering I just had recently bought a speck candyshell (returned because it was too thick for my taste) for 34.99. The packaging for the new cases look identical to the old ones from what I could tell. I just held my phone up to the side of the package to make sure the mute switch cutout was in the right place.

I went to Walmart on the way home and saw a new Incipio display in the middle of the cell phone isle. I mean every Incipio case was there. I found the NGP w/ the right mute switch cutout. Pics below.

Left is the OLD w/ small cut out and Right is NEW w/ bigger cut out.

The 1st pic shows both boxes, note the "new" one has doesnt say iPhone 4 on the left corner sticker.

My 1st impresson was when I took the new out of the box was that it was less "smoke" color. It looked like a dirty clear case to me.

2nd was that it looked a bit smaller. I took off the case on my phone now and compared it and it was a bit smaller. I dont think the case could have stretched that much in 3 days, maybe I'm wrong.

3rd and most important was that it is smaller. Smaller and tighter, so tight in fact that when I put it on my phone w/ front and back Power Support protectors, the new case pushed up 3 corners of the front protector. WTF is that?? Anyways I immediately took it off.

Is the new one I bought defective? Besides being lighter in color, it is smaller. I think I'll keep the old one w/ the smaller cut out.
