Darn, I thought that the fact this thread was at the top meant there was an update. Oh well.

You do realize that if this was the case, and the person was apprehended, and his computer was subpoenaed, and they came after the people he fenced the goods to thru ebay, and they subpoenaed YOUR computer, you just implicated yourself for all the world to see.

Everyone loves a good deal, but admitting that you willfully bought something under the assumption is was purchased with a stolen credit card is tempting fate my friend.

It's not my problem. I just assumed, its not like i KNEW for sure, and it was mostly an after thought hoping it wasn't an actual scam. Damn my lawyers are good :)

you just bought a brand new in box free ^^&&

What a sucker. :D

----------

But the description says new brand new iPad mini. I think he stole a credit card and bought 5 iPads and wanted to get rid of them quickly.

*Update*

It has been marked as shipped. He lives in the same state as me so it should get here in a day or two, if it's real that is. Either way it's covered under ebay buyer protection so I'll get my money back if it's a scam so not really worried about it.

See that's how scams work. It takes larceny in the heart to make a mark.

And your the Mark, thinking you got in on a hot deal from the equivalent of the white van selling hot speakers in the parking lot.

I bought an iPad 1st gen brand new never opened for $58.69. Not bad right?

Please be honest when posting here. You did not buy for $58, but instead for $98. The fact that you had some other means of payment DOES NOT CHANGE THE PRICE YOU PAID.

Sort of like saying, I bought a Ipad Air for under $100 because I had a $400 Apple Gift Card from my Mom.

Geez.

He hasn't actually bought anything anyway, until it shows up, which it probably won't, so he's merely paid for it, not bought it. :D

I paid $58, so i bought it for $58, it was a discount from the retailer, not a gift card.

Ok so I have no package. i have opened a case within Ebay saying I have not received the item. The seller has until November 14th to respond, then the case gets escalated to Ebay.

i guess it's the 'They told you so'. good luck and hopefully you get your money back.

It boggles my mind why the scammer listed it for 90 bucks. It only makes him look way more bogus and he gets way less money out of the scam. The only reason why I could think of is that his total net amount would keep the crime as a misdemeanor, so he could avoid a felony charge if he ends up getting caught.

Don't worry you will get you money back. PayPal will always side with the buyer only in rare instances will the seller win a dispute. I've sold a lot of stuff on eBay and you never ever want to buy or sell to folks with negative feedback.
And like most have said if it is too good to be true it isn't... When you are buying a popular item on eBay check all the listings to find the average selling price and expect to pay the same. Look for a posting with good clear pictures of used items and an accurate description of the condition. And always use PayPal never send payment directly to a seller or you have no way to dispute.

he got negative feedback AFTER I bought it from him, to me it just looked like a new seller. But yeah there were a lot of red flags I was just hoping that 1 percent chance it was real, oh well. The case will escalate to Ebay on the 14th. I am just wondering, do I get my $40 coupon back too?

What $40 coupon? You made it clear that you didn't pay $98, you paid $58, when that guy said please be clear about how much the item realistically cost regardless of gift cards or ebay special thank you offers or whatever.

Well it depends on what the "coupon" was. eBay bucks?

Like the old saying goes " if it sounds to good to be true ........." You can fill in the rest :D
