I MAY have committed every crime in the book... this is so confusing/ doesn't seem very concrete.

Like I said, you would get charged for EVERYTHING. However only a few of them would get held up in court. Better be safe and keep the trip alcohol free. I hope you make the smart decision, you seem like an intelligent enough guy. Good luck getting your white iPhone! ;)

I'll die if they don't have it... what's funny is that a few days ago I posted a thread about being able to survive NOT caving in for the black iPhone... UGH.

I said that I know I would be in deep water for doing it. Where do you come off saying I'm "not speaking professional". I was just responding to a question and I felt that little bit of information was relevant. Please show a little respect. Thanks.

I absolutely meant no disrespect at all. My apologies if it was taken that way.

I was just trying to say that

it was edited in after the thread moved to next page i guess.

Your report would say I think he may have sipped it or was intending to sip it but he blew .00 and passed field sobriety test but im charging him with DUI.

Really?

You do realize that breathalyzers have a degree of inaccuracy, and a sip (illegal for a minor) would not register on a breathalyzer in the first place, right?

I was arrested for a DUI after passing a field sobriety test and blowing a 0.00 on a breathalyzer, and I'm even over 21. On the way to jail, I asked why I was arrested if I didn't have any alcohol and he clarified that he suspected me of being under the influence of drugs. That's the proof you wanted, isn't it? A suspicion of drugs is on par with a suspicion that a minor operating a vehicle has had a sip of alcohol in a car full of young men on a road trip with open containers.

Oh yeah, and I was pulled over while traveling 15 mph in a 15 mph zone at 3 am in the morning.

The judge dismissed the case when I appeared before him six weeks later with the results of the blood test.

Yes of course there is a degree of inaccuracy but my argument was against the probablilty of such a thing occuring as there is no possible way of making the charges stick as you have stated yours were also dropped

But im wrong then, as i did not think an officer would possibly arrest someone knowing there is no chance of charges sticking. that is absolutely crazy to think about  and i would still lean to the side of this is not the norm within the police community.

Good discussion though everyone :D

It wasn't about making the charges stick, it was about getting arrested in the first place.

Long story short... REALLY wanted the white iPhone - said I wouldn't get anything but... Well Apple is killing me... I live in Pensacola, FL and the nearest Apple store is 3.5 hours away in New Orleans, LA. I am going in hopes of a white launch and if not I am caving for the black...

My friends want to go but they want to drink in the car on the way there. I would never drink while I am driving but they want to... I am paranoid and wonder what would happen if say, I caught pulled over for speeding and the officer noticed the alcohol. They are all 21-23 but I'm only 20, however I will not be drinking anyway as previously stated. I know there is some type of "No open container Law" but... anyway...

So what would happen to ME if this situation occurred as far as the alcohol goes.

Thanks guys.

Did you talk to a lawyer after the incident?

Florida: Roadblock Nabs Sober Man for DUI
A sober Florida motorist is arrested twice for DUI despite blowing 0.00 on the breathalyzer.

A man caught in a Florida Highway Patrol roadblock faced prosecution for driving under the influence of alcohol (DUI) despite evidence he was perfectly sober. Port Richey motorist Joseph Errichiello was minding his own business when he was stopped and interrogated by state troopers on September 1. Errichiello does not drink alcohol, but he has a learning disability that officers at the scene could not distinguish from intoxication. The officers confirmed their mistaken hypothesis when Errichiello failed a field sobriety test.

"I did nothing wrong and I got arrested for it," Errichiello told WTSP-TV.

Errichiello showed in an interview with WTSP that his lack of coordination prevented him from passing the field test, despite being sober. Errichiello has more than just his word on his side. He willingly submitted to every chemical test that police offered. The breathalyzer test reading came back 0.00, as did a urinalysis that also checked for drugs. On September 13, a Pasco County Sheriff's deputy arrested him for drunk driving a second time. Testing showed, again, that Errichiello had no alcohol or drugs in his system. The state attorney's office has not formally dropped the original charges against Errichiello, although it may do so once the urinalysis paperwork is submitted.

California defense attorney Lawrence Taylor slammed the Florida prosecutors in a post on DUI blog.

"I guess Joseph doesn't understand that there are some things more important than justice," Taylor wrote. "So how important is evidence if a cop has decided to arrest a citizen for drunk driving? How important if it shows innocence? And how important is evidence to a prosecutor... or is justifying a bad DUI arrest more important?"

Wow, seriously?

A. Your priorities are f*cked up.

Yes, getting the new iPhone is more important to me that worrying about a traffic ticket... as far as the alcohol, well I wasn't drinking so if I did indeed get some kind of ticket for that then Oh well. My record is clean and I have nothing to worry about. So at the point of me getting a ticket... there is NOTHING I can do to change it and worrying does nothing to change the situation. So yes, iPhone 4 is more important to me than stress.

I'd lmao if your buddies got kicked out of the Apple Store because they got too drunk on the ride over.

b) get new friends
3. You need new friends lol.
Find new friends.

People, I never said that my friends just HAD to drink... they just wanted to... and all I did was asked what would happen if X situation occurred... dang.

Just shows bad judgement on their part that they would even suggest it to you. Especially knowing that you would be the one with the most to loose and bearing all of the responsibility as the driver. They don't have your best interest in mind. The request was selfish on their part.

I didn't bother to read the thread, but I thought I'd add that Vodka looks like water when its in a water bottle. Mix it with something and carry that in a Powerade bottle.

We stablished early on that this was a horrible idea and that the OP should not do it.

His friends on the other hand for asking are just being young adults doing what young adults do. Im not all that surprised by the OP's question or situation, sounds pretty standard, if you don't think so don't be so naive.
