All right guys here is the update.

Just came back from the Apple store on Michigan Avenue from downtown Chicago and no dice.

After talking to multiple employees, non of which were aware of the issue, the answer that i got was that i need to call applecare and have them see if they could exchange it. Because the phone was bought from apple.com, non of the retail stores can take it back for an exchange.

A little pissed, but now i must call them now.

Just to be clear - did they refuse to exchange it at all, or just refuse to exchange it for a new "retail packaged" phone? I would expect this to be as eligible for a service exchange as a unit with a dead backlight or other warranty problem. However if you are insisting on a new retail packaged unit, then it will need to be returned/repurchased, in which case the restrictions you describe are consistent (not judging whether they are right or wrong, just that they are consistent).
 
They're BS-ING you dude, if I were you I would've called a Manager ASAP.

This is an obvious DEFECT, and it should be replaced.

Don't bite into the whole "Ship it to Apple stuff"...

If you do, tell them to setup a UPS replacement. You'll overnight it to them,
then it'll arrive the next-day (to Apple in California), and then they'll ship it back to you (the same day they got it) overnight...Your replacement iPhone should arrive to you by 10:30am via Fedex (For Free).......

But THEY SHOULD replace it at an Apple Store.

Sorry but this thread really pissed me off, it's embarrassing how they treated you!
 
something isnt making sense here. I know some apple employees are dicks, but you called apple support and they told you to return it?

Are you trying to get them to exchange it for a 'retail box' unit? becasue thats all that would make sense here. and explains why they turned you away on mich ave.

and you dont "need to drive 60 miles" the old orchard apple store is a straight shot on the expressway from mich ave. jump on 94 to old orcahrd road, bada boom. its like 10 miles

and also, the replacements they give you at the apple store right now are new ones.
 
Didn't realize there was one in old orchard, sweet. I'm not picky, I'll take a new or a refurb. Maybe the next store I go to I'll specifically ask for a refurb.

I just want the issue resolved, rather it's a refurb or not. I'm not looking to cause any trouble, scam anyone, get free stuff, or anything like that.
 
Yeah, I have one more apple store I can go to. I don't think I'll mention that it was bought online. I can only got to the same store so many times and let's face it, it's not like this is a best buy where there a few in a certain mile radius. I'm not gonna drive 60 miles just to be denied.

Umm, I can see the angle here... and if my phone was messed up some other way, scratches etc... I might try to get it swapped.

But I wouldn't loose any sleep over it if the said no... I mean, I didnt know the buttons were even labeled. And I have never had to examine them to determine how to turn my volume up and down.

Now if you are saying the top one makes the sound go down, and the bottom one actually makes the sound go up?? Then I might want to get that replaced.

So then just make a Genius appointment and ask for a warranty exchange. The replacement will be brand new at this point. You will only get the iPhone 4S, not a new box and not new accessories. This is exactly what you would get on day 31 anyway so not sure why some are so hung up on doing a return / purchase a new iPhone 4S. :D

If you were previously asking about returning an Apple.com purchased iPhone at the retail store for a new shrinkwrapped retail iPhone 4S that would have resulted in the responses from Apple Care and the retail store you posted earlier.

Like a previous post said, I would wait until month 11, then swap it for a new one. Sell it on eBay, get $$$, buy iPhone 5.

Plus, think of it as an icebreaker with the ladies.

It depends what you're trying to do.

If you just want to get a replacement from one of those white boxes, Apple will gladly replace your 4S even if it was bought online.

BUT, if you're looking to return it to get a new one or a retail box exchange, then you can't do this at the store. You can only return @ a retail store if you bought it @ a retail store.

I know this because I ran into the same issue about getting a replacement @ the same Apple store. They gladly offered me a white box replacement but I didn't want one of those purely due to semantics. They ensured me that it wasn't a refurbished unit since the 4S hasn't been out long enough for them to have any but I still didn't want one.

The volume buttons work like they are supposed to.

There is also an Apple store in Lincoln Park if you live in the city.
