I think the thing on the top part is just the glare. The scratch is literally that tiny line where the apple stem would come from.

agreed. OP, can you let us know if this is true? If that is the scratch, I really think that is super minor and you can only see it if you squint and know where to look.
 
There's a big topic about a fair number of people having damage out of the box and a tiny number claiming how easy the black one allegedly scratches compared to the white. Your best option would be to buy one now and join the vast majority with no issues and no worries.

That's a "big huge scratch"? You need to get out more, smell the outdoor air, get some sunlight. You don't think that would/could have happened the first time the OP put it in his pocket? Don't you people have better things to complain about than something as idiotically mundane as this? There IS a presidential election going on after all.

Somebody wanting to have a product that they paid for to be in excellent condition isn't mundane. And devoting time to it doesn't stop a person from processing what's going on with the presidential election, either!

Amen. I EXPECT such an expensive product...which allegedly carries the Apple promise of quality...to arrive in pristine condition.
 

So you're saying the guy who had his black iPhone 5 replaced 4 times due to scratches was random? I'd say it's fairly common if it happened to one guy five times. They probably all have a bit of scuffing that's unavoidable.
 
I took my phone to get replaced due to dust on the internal camera sensor and two replacements had scratches on the edge. The first one had numerous defects. The second had a gouge right near the lightning port on the front but I didn't notice it till I got home. I swear the replacements are the ones that didn't pass the QC for cosmetics.
