All of this could have been avoided with proper communication. I'm pretty sure Apple looked into the possibility of how throttling may be perceived as planned obsolescence (especially with today's consumers). I am surprised that they did not communicate their full intentions to begin with. As a result its perceived as if Apple was caught doing something malicious.

Yeah, because actually notifying people that they had the additional option of replacing the battery to restore it to as-new condition would have affected their planned obsolescence strategy. Minor detail.
Actually, they want the devices to last longer so people continue subscribing to more-profitable services.

And Italy is blamed for making a "cash grab" by the apologists here...

Discovery is undoubtedly underway in the US class suit. Will be interesting to see how this plays out.

You can still subscribe and buy newer HW, I think they call it "Eco-System", the one that makes you keep buying their stuff :D

Where did they lie? It was noted in the update that no one reads what it was doing, just not in explicit detail. The alternative was stupid, recognize the aging battery caused spikes killing old devices, but do nothing, meaning they get to sell you a new one. They chose to extend the life of the device by predicting the damaging spikes and decreasing conditions to minimize the spikes.

Offering the cheap battery replacements on devices several years out of warranty was a nice gesture that showed it was not a software issue but instead a old battery.

Some people DO read the update details. Apple didn't lie, they withheld the specific details that could have avoided this mess (i.e., communication mistake). If you leave specific details out, society will assume and arrive at their own conclusions (which they are free to do so).

Can't believe how low some poeple would go to defend Apple, yes it is a great company, but when they srew up they should get called out for, and I am glad Italy did the right thing!

It's easy to defend Apple in this instance because of the known limitations with ANY lithium ion battery in a phone. Can Italy claim that lithium ion batteries do not actually become inconsistent for voltage supply at 80% or lower total capacity? No. Can Italy claim that a lithium ion battery does not become inconsistent for voltage supply at 20% or lower total charge? No. Can Italy claim that cold weather can't negatively impact the voltage supply of a lithium ion battery? No. Can Italy claim that Apple's software update didn't functionally address situations where voltage demand could be too high than voltage supply? No.

Italy does not have to prove Li ion batteries usage, they never faulted apple for the battery, but for how they communicate, or actually don't.

Italy does not have to prove anything, it is Apple who has, they messed up in communication, and got called out, now they will have to post in their page the info!
P.S. Samsung got called too and they too have to pay, it is not only Apple.

A simple solution to this problem would be to allow us to install earlier iOS versions on our iOS units.

My iPad 2 with iOS9 is almost unuseable, so it has been delegated to be a youtube viewer for when the kid wants to watch something. Had to upgrade to a newer model as a replacement, but if I could downgrade to iOS7 I would do so instantly, and would have delayed my iPad model upgrade.

If Apple really wanted to push users into new phones, they would be well within their rights to only do 2 or 3 years of software updates, like hundreds of Android phone models get away with.

It's not a direct comparison. Google updates its core pieces of software on Android phones, even if the manufacturer doesn't issue new major OS updates.

With Apple, if you don't update the OS, you cannot get updated Mail, Safari, App Store, etc.

Difference is Samsung allows you to downgrade the OS unlike Apple.

$10 million isn't a fine but an incentive for Apple to pull another similar shenanigan.

At the last Keynote, Lisa Jackson, the former EPA administrator and head of Apple's Environment, Policies, and Social Initiatives specifically outlined Apple's focus on making products last longer.

They want you to buy their new products, but they also want people to buy the more-affordable used products and subscribe to services. That makes a lot more sense than planned obsolescence.

LOL exactly my thoughts

Some people here prefer to bash a whole country with nonsense about nothing working and eu budget when they do not even realize what has been ruled is just fair, even too soft in terms of fine to be paid if you ask me.
Apple really screwed up and yes, they caused damage to people omitting that they were going to slow down all phones, even the ones without issues.
in my case I own an iphone 6 that was artificially slowed down and guess what, my battery health is 87% and the feature never really ended up being used, right AFTER they gave me a choice about it.
Shame on Apple.

Hey now, I do believe that Apple did planned obsolescence and should be fined. It should be fined even more because I believe they do this to Macbooks and iMacs. This is wrong. It should be punished. And that's what happened. So, stop whining about things in Italy, Europe, or the moon.

There it is. And are you really defending Apple here? Wow.
Anyway if I go to a mechanic to fix my car and he does it but does tell me he did in such a way that the power was permanently and severely reduced it would be bad, really bad. Apple didn't want to tell people that they had to throttle the CPU to avoid random shutdowns, that's more than clear.

Offering the cheap battery replacements on devices several years out of warranty was a nice gesture that showed it was not a software issue but instead a old battery.
Nice and all, they were actually force to do this gesture.

I don’t understand these. Who gets that money? Not th consumer that delt with issues like this so why should someone besides us get the money? Makes really no sense to me.
But cutting a check for 5$ per person isn’t really anything. I’d be happy if everyone that say owned a 6+ after two years that experienced this got back a certain amount I’d be happier about these. Offer a trade in on that phone for no out of pocket cost. Yea that wouldn’t ever happen.

I bought the 8+ when my 6+ suddenly slowed down so much I started missing rides on Uber and Lyft. It cost me money and I had no idea I could just put in a new battery and it would be fine. I was super pissed when I found out that was where the problem was and I had already fallen in love with my 8+. Now I have a new battery in my 6+ and I just keep it for a backup phone. I can’t bring myself to sell it for only $150

Of course, they also said that iOS 12 was making older phones faster, wich in here people say it was impossible as new SW is definetly heavier.

Of course Apple said that, it is called PR.
