Looks like Apple will refund me the money as well. I bought a touch yesterday and it had no apps installed. The response I got back stated that "your iPod Touch should have definitely had those apps installed at this late date". These apps should have been on right from the start, but you can't blame Apple I guess for refunding me the money...
 
Just keep trying...sent the first email late Friday night, received a response the following morning asking for the date,location, and cost of iPod Touch purchase. I bought it new off Ebay but wasn't sure if that would be a good answer, so I just sent another email to customer service. Received 2nd response today from a different rep, she just asked for my order # and after I responded, granted me my refund.
 
I bought the Software Upgrade twice accidentally (iTunes was being really weird the morning it came out) - just sent them an email using the form so should hear from them soon enough.

I'm taking this advice and trying again as there doesn't seem to be a consistent policy on this - I'll see what happens if I get an answer from a different customer service rep.
 
I tried the JailBreaking and frankly was nervous about having to "re-break" and honestly want to have legit software that is supported on my new iTouch.

When I first heard of the new Upgrade, I was ok with it and bought it. When it was announced it would be added to iTouches from the factory, yet early adopters woudl pay for it, that wasn't right.

So, I emailed customer service the following:

I purchased the January Update just to find that these features will be added to current and future sales of iPod Touches at no additional cost or required download. As a new iPod owner coming from using other brands, I was excited about the exceptional experience I was going to have after spending $399 on this device and enjoying the iTunes offerings...

I am disappointed that this is my first experience with Apple and while $20 isn't alot of money, it communicates the wrong idea to your customers....

Would you consider refunding my charge as a goodwill gesture to a new Apple iPod touch owner?


I received a response in 24 hours and a refund was initiated to my PayPal account....and i get to keep the update.

Way to go, Apple! One satisfied customer!

Customers like you ruin the business world.

Bought my Touch on the 1st February and bought the extra apps, after seeing this thread I e-mailed them nicely this morning and within 12 hours they gave me a very nice reply and refunded the money back into my account (store credit).

Okay, so being a bit dishonest, what if you say you purchased your iPod Touch after January 15, but in reality you purchased it a long time ago, in October. Can they check that somehow or if I say I purchased it two weeks ago they will just give me my $20 back no questions asked? Thanks.

I never mentioned a date just said I purchased mine 'recently' and gave no mention of refund in my first email, just complained about it being a bit un-fair, "Apple TV = no pay, iPhone = no pay, iPod Touch = of course pay!".

First person just told me they were 'sorry' and referred me to here. Sent a second one asking for a refund and got it! Not even store credit, said they would be sending it directly to my card.

Apple should treat all of you equally and send a refund to everyone. In fact, if they are sending refunds to some people who are asking, they should refund everyone and provide the update for free.

Makes me sad to hear that Apple is doing this :(
