He shouldn’t be in active communication with Apple. He should be in active communication with his lawyers. Let them do the talking and don’t miss anymore court dates
Unless something changed, I think he is representingting himself and does not have a lawyer..

And if he failed to respond in court, that is all irrelevant since there was a default judgment issued. That is a 1L procedure fail right there.

There is nothing to settle anymore. Apple requested and was granted a default judgement because Prosser apparently didn’t respond in court to Apple’s allegations leaving him open to a default judgement. The damages may be mitigated through a settlement negotiation but he has lost the case unless he is able to successfully appeal the default judgement (highly unlikely since his inaction caused it to be entered in the first place).

Succinctly correct.

No, it's not. Apple submitted documents to the court declaring that Prosser has not responded to the suit. Unless we're to believe that Apple's lawyers are willingly throwing away their bar licenses and opening themselves up to sanctions, Prosser is lying through his teeth.

I suspect that what they said is that he hasn't responded in court (not that he hasn't responded to them). And as far as the court is concerned, if you don't respond to a lawsuit, you are done and a default judgment can be issued.

It doesn't matter, it's clearly a material omission for a party to ask the court for default judgment while secretly negotiating a settlement on the side. You don't play word games with a federal judge. I would be slightly more likely to believe it if the case actually mattered, but over this picayune nonsense? Please. There's a 0% chance that's what happened here.

This is federal court so he'd have up to a year (FRCP 60), but only for good cause like fraud or misrepresentation, improper service, newly discovered evidence, etc. He doesn't have a prayer.

Yes because that’s what they do use all the money available to squash the little guy from YouTube but it’s a different story when they come up against epic and Spotify and governments who have the funds to take them on it’s a very different story isn’t it

Yes, he has to be careful what he says, but if he’s trying to refute apple‘s position, he didn’t.
 
I wish Prosser my sincere best. I find Apple’s lawsuit wholly misguided. They ought to be going after their former employee, for his sloppiness and negligence. The sight of an ultra-resource-wealthy Apple going after individuals lacking such obscene amplitude of resources makes my stomach turn in disgust.

If what they claim he did was true, he’s a colossal piece of garbage who ruined someone’s career who did nothing wrong but happen to choose a bad roommate. Just for that he should be sued by that guy. As for Apple, I’m fine if they crater him financially on top of it for profiting over stolen trade secrets.

I agree, the court will ask for the docket numbers for his filings.
 
I’ve always thought Prosser was a bit of a prick but I don’t necessarily think he deserves to have his career and financial life ruined whether he’s actually guilty or not. But he’s also an idiot for getting involved with anyone shady enough to do something as blatantly wrong as tricking a friend into allowing him access to a private device through deception. That’s the guy who really deserves Apple’s wrath

I do not consider speeding at over 90MPH in a 35MPH child zone as being intelligent, yet that is exactly what Marques did, nobody is perfect. Also I don’t see any ‘real’ criticism from Marques in his reviews either because if he did he would not get to interview Apple Execs or be given free review samples. But.. he is better then Jon.
