Well lets see:

- OP enters an agreement with Apple with the clear intent NOT to honour his part of the deal (read actually paying for the Mac)

- OP gets a benefit (2-4 weeks of free iMac)

- Apple suffers damage (p&p back&forth, repackinging and sale at reduced price as "refurb")

I'd say that qualifiues for fraud in most civilized countries (wether it can be prooven in court is a different matter).

Also note, not all criminal acts are criminal offences in a legal way (think of all that happened in the finance sector over the past 6 years) while not all criminal offences require an actual criminal act (think of some backwater countries were just being "different" might qualify you for a stoning....).

Please show us where on Apple's site it says you cant buy a computer and return it within the allotted time frame. Or call Apple and ask them and see what they say....

......I am not condoning this behavior but its perfectly within the scope of Apples return policy....I buy a ton a of stuff from Amazon because they have a 30 day return policy. They WANT me to buy stuff. They prefer I keep it but they also want me to be able to send it back if I am not satisfied (on there dime mind you) so I will keep buying from them....Which I do...
 
New iMacs have been out for days

I don't understand why MacRumors has failed to inform everyone that the new iMacs were released Saturday at midnight?

Everything at Apple is "The New Thingy" until its replacement comes out. In some countries, this has gotten them in trouble with law enforcement. Seems to be ok so far in the US though.

Check the footnotes on the graphics performance. "Testing conducted in April 2011 ..."

This page hasn't been updated, outside of header/footer, in over 400 days.

Looks like I owe the forum an apology. I was taken in by sleazy advertising. This is just one more indication that the visionaries at Apple are being replaced by corporate bean counters. How sad...

Perhaps you're right. Maybe I've been blinded by my own enthusiasm for the product. In the beginning I got a kick out of rooting the underdog and being an early adopter. You may well be correct that the corporate persona has always been this way at Apple. Thanks for pointing this out.
 
If it's a no questions asked return policy I am not sure it qualifies as "fraud." Unethical maybe, but not illegal. Regardless, I think this behavior is likely pretty rare and hence not a concern to Apple. I mean, what a PITA to purchase, unbox, and set up a computer only to wipe the HD, rebox it, initiate the return and lug it up to fedex/ups 28 days later. I wouldn't bother with the hassle, I'd just wait a month to buy and see what happens if a refresh is expected.

That being said, if I did happen to buy a new iMac and had no idea a new model was imminent (which doesn't happen, because we all read macrumors, right? ;) ), and that new model released within the 14 day window of my purchase, I wouldn't hesitate to return it for the new one. I'd tell Apple exactly what I was doing and they would happily do the swap. With the margins on these computers they can make those swaps, sell the "used" computer as a refurb, and still make money on both machines, plus keep a couple happy customers.
