Yes, and they don't prove anything aside from the facts that it's another person on the internet with bad grammar, probably the result of having a better language of command. There's another side to this story, as there is with any.

Do you also think it's fine to sell a PS3 box on ebay by implying it's a functional video game system?
This is like the person that sold the iPhone boxes and listed them as nothing other than boxes. All that was pictured was a box, all that was described was the box. Then the buyers that paid hundreds of dollars got mad because they paid so much for two pieces of cardboard.

I don't understand why you want to carry it on and on. No matter what other people think and no matter how many times you try to justify your correctness, it won't affect your outcome. Paypal is going to force the seller to refund you like they always do.

Sounds like seller didn't know what he was selling but rudeness was unnecessary. He could also be a sneaky eBay user trying to get his money's worth. Who knows? That's the thing about eBay... you're taking a risk as buyer or seller.
 
take the 30 rebate, load the os on bootcamp abnd leave the seller nuetral feedback, its not that big a deal

Yeah, but I don't currently have a Mac to test it on :( I'm guessing if it doesn't work on a PC it won't work with bootcamp

BTW PLENTY of sellers sell Dell/Lenovo/HP, etc. version of reinstall disks on ebay honestly, without being sneaky and with full disclosure.
 
I think that the seller might be a little peeve since you started a dispute before contacting him, just cause he is a uninformed seller does not mean that he meant to scam you.

No...the guy is absolutely Coco for Coco puffs :p He's insane if you've read any of his responses (I can share more if you'd like--see below). He's also claiming I've sent him "dirty" emails, which I of course haven't. Actually true about the laptop, missed that.

The thing was shrinked wrapped. I actually thought there wasn't a disk in it until I removed the shrink wrap. The disk wasn't sealed by anything additional. Seller is trying to claim if you open a box, you buy it, and no returns are allowed, that I "took the risk". That's just plain ridiculous. What does that mean, especially coming from a seller. It's pretty much an admission of guilt on his part.

I called paypal, explained everything, and the rep basically told me not to worry about it, and said I should escalate it to a claim, which I did. (I was actually impressed with the PayPal reps, they're very helpful and understanding)

Why are you even buying Vista if you don't have a Mac and you can download Windows 7 for FREE? :confused:

I'm getting a mac (again) in 36 hours, and the Windows 7 demo is just a demo. It's still uncertain if MS will allow you to upgrade directly to a full version of 7 from the demo.
 
You really can't pin this completley on him. You're also at fault for purchasing an item that was poorly described and documented.

Hopefully this will be a lesson to you, next time just get your software from a real retailer. Just imagine an extra few bucks could have bought you this:

It's really not my fault the seller is a jackass and lied about how the disk "retails for $199." I've bought many expensive things on ebay, and if we hold sellers to such low standards and give them the ability to mislead buyers, we're going down a shaky path. Yeah, I took a risk, but crappy ebay sellers should not be allowed to be dishonest or ignorant of the products they're selling and keep the money given to them.

In retrospect, this is now the 3rd time I've had a problem buying on ebay. One was a obvious fake BB battery for $5 (not a big deal, more a optimistic joke), and an insane police officer who sold me a phone and started to make threatening phone calls to me after I refused to ship back his porno filled micro-SD card next day air at my expense!
 
According to the EULA, it's illegal to install this version of Vista on any machine other than the one it came with. The seller was purposely being deceptive, though the OP should have looked more closely.

I've been buying and selling on eBay for about 6 years now, and in that time I have had only one transaction go south and that was where a seller flat out sent something different than what was well described, and refused to return and exchange the item for the correct one, or refund my money. Luckly it was only a $20 cell phone case, but that is the risk of dealing with people on eBay. The only thing you can do to improve your odds of avoiding such situations in the future is:

1. Only bid on items from reputable sellers that have feedback from selling in the past.

2. Only bid items that are well described and photographed with actual pictures of the items for sale. If the auction page looks like it was put together in a matter of seconds and for cheap, this is a big warning sign that you've either got an inexperienced seller or someone who flat out doesn't care.

3. Only bid on auctions that offer DOA warrantees, return policies, exchange periods, ect unless the item is previously known (and mentioned in the auction) as being untested and sold AS-IS

4. Never buy software on eBay. The only exception is if it's really really cheap, or can't be found anywhere else. Otherwise there are to many problems with licensing, possibilities for fraud, along with tons of other problems.

Following those 4 things will almost always ensure that your transaction is positive, and that it works out well for both parties. Otherwise you're taking a huge risk, and will likely continue to get burned in the future.

And this is the sticking point.

A Lenovo reinstall is NOT a copy of Vista, it is an OEM operating system that you are not supposed to use/sell for use on another machine. And to all those thinking that MS doesn't lock down OEMs to single machines: they do. It is based on the motherboard(replacing your mobo works, new mobo often will not) and requires you to call in for reactivation.

Of course, both sides are to blame: sorry OP but you bought something that was very non-descriptive and at the same time he broke the EULA and sold you something you cannot use. Next time just get an OEM channel copy from NCIX/Newegg.


P.S. That seller sounds frigging nuts, I wonder what his damage is
