In other words, if you dump your iPhone for another device (remember a handset that supports data is a smartphone, just uses a non iphone plan, like a samsung phone or android device, etc)... so yeah, they're covered. And only people eligible for iphone upgrade are those on upgrade, so yes, they're contractually allowed to cancel your upgrade eligibility for swapping sims.

On the opposite side of this discussion. Can a non iPhone user with a data plan swap a sim into a 3G (broken screen and roommate has been using as an ipod)and call apple to have their date moved up? Upgrade date is September with a POS Fuze that has been replaced 3 times.
 
OK, so I was a little concerned about this, because I have been using a blackberry pearl for the last 4 months, because my iphone 3g broke 3 months ago, so I just now checked my att account, and where it has the picture of the phone you are using it has a picture of the pearl, but from what I can tell the bill hasnt changed, but does this mean I lost my unlimited data plan? Or does the picture mean nothing?
 
The upgrade bump applies to all AT&T customers, not just those with iPhones. My friend was eligible on 7/1/2010, but got the same upgrade bump I did. She's a Blackberry user without a data plan, so I really don't think AT&T cares what phone you're using.

If I remember correctly, Steve said anyone with an AT&T upgrade date in 2010 gets immediately eligible. I really don't know what this debate is about... And AT&T definitely does NOT sweep your IMEI if you're on iPhone plan. They just want to make sure they're getting their $$ out of people using iPhones without data plans, not the other way around.

im not worried about the upgrade, i am due for an upgrade even without the bump, I just dont want them to take my iphone unlimited plan away

Can someone else confirm this please? I am in the same situtation...

I sold my iPhone in April and popped my SIM into a BB. Because of that, I am not eligible for the $199/$299 price since I need to have an iPhone active.

So if I purchase a used iPhone to activate it, will I be eligible? If yes, how long will it take to go into effect?
