iPod 4 and iPhone 5 on iOS6
Wasn't there an option to update to iOS 7 where FaceTime is working, of if the device wasn't supported by iOS 7 then wasn't there an iOS 6 update provided to get FaceTime working on the device?

We all pay the price for these frivolous lawsuits...it must end.

This is the most ridiculous argument I've read this year. Everyone that actually uses Apple products KNOWS that every OS upgrade means SLOWER performance and that this is done on purpose to "encourage" users to buy new hardware. Thus, there are good reasons why people don't want to upgrade to the newest OS. The problem is that Apple developer kits make it very difficult on the developer to support older OS builds and again, that is a CHOICE Apple makes on purpose to "encourage" people to upgrade. Of course, some hardware isn't allowed to upgrade at which point Apple kindly tells you to buy new hardware because that four year old device is a useless POS and needs to be put into a landfill (because Apple is such a GREEN company, of course). And this idea that you will pay less money for a new product that has ALREADY BEEN LAUNCHED (like they're going to retro-raise the price and demand you send them another $50 to fight this lawsuit) is even more ABSURD.

It amazes me how people just drink whatever water Apple hands them and don't ask what's in it. Blind support for corporations whose sole purpose is to make money at any cost strikes me even stranger than blind faith for religion as the motivation there is clear (money/power). That makes sense for a corporation, but not for the followers who are generally taken advantage of and used by the hierarchy that actually benefits them. Therefore, I can only assume this is a genetic addiction of some sort and as such, I think we need a 10-step program to help such addicts recover.

Suggested ACD 10-Step Program (starting after the addict admits he/she has a problem and wants to get better) for getting rid of Apple Corporation Addiction (aka ACD):

1> Remove all Apple gear from offender's house.

2> Dunk Apple fan's head in barrel of water with oranges in it (no apples!)

3> Put Apple follower on a cruise ship for a 30-day cruise and tell the cruise line to not offer any WiFi to said passenger or let them near the computer lounge. Send buddy along to watch them lest they try and break into another person's cabin they see carrying an Apple notebook. Make them eat dinner at the group tables and play shuffleboard!

4> Monitor Apple addict at home for 90 days, making sure they stay away from Apple products.

5> Assign a 'buddy' to make sure said Apple head doesn't go near an Apple store or web site related to Apple.

6> Introduce Apple addict to actual social programs that don't involve computers/phones/headphones (e.g. dating, non-computer clubs, etc.)

My sarcasm was based on the face that I find it ludicrous to sue because hardware is ancient and more features are available in newer models.
Except, again, this is about something that's somewhat different from that.

There are any number of reasons someone might not want to upgrade to the next OS, including the fact that older hardware tends to run newer software more slowly, as mentioned in the OP.

Would it be okay if they intentionally put in a bug to prevent WiFi from working unless you upgraded? To prevent voicemail from working properly?
Its industry standard now to do these practices. Why do you think a perfectly working phone becomes so sluggish in 3-4 years that it needs "the best iPhone ever" replacement? Its pathetic what these greedy pigs do for money.

3-4 years is ages in the mobile computing world, at least until very very recently when the pace started to slow down a bit even though it's still going at a decent rate. For example, compare computer profession and performance in the 1990's or even early 2000's and how much things would change between models that were 3-4 years apart.

Every OS bar iOS 10 has always slowed down the previous iOS release. iOS 10 is an exception simply because iOS 9 was a the worst release I had used since Vista and 10 had to fix up all that mess. But a faster or similar speed iOS upgrade is an exception rather than a norm and considering that neither Windows nor Android releases slow down the older devices And allow you to downgrade it's fair to say Apple does it on purpose

The sad fact is that Apple can pull things like planned obsolescence, error 53, intentional FaceTime bugs, Touch Disease and get away with it because they can simply use their cash to bulldoze their way though any lawsuit .If Samsung or any other companY on Android tried these stunts they would get bankrupt . The price of the phone paid is independent of the service and you still get the service for free. You do not have to pay extra; you can't opt out. The price is the price. Just like BMW free maintenance; you do not have to pay for the service and you can't opt out, it's still free to you. Can you tell me how much your 1 year hardware warranty cost in the price of the phone?

Let's face it. When you buy a phone 100% is not pure profit to apple. They have fixed and variable costs that are built in to the price: buildings, salaries, taxes, labor, materials, r and d and support. All of that is baked into the price and you can't opt out of any category. When you buy a windows product you get free updates for the life of the product, can you enumerate how much you pay for these "free updates". All you know is that you don't have to pay extra for them and most products include 1 or 2 support incidents, free of charge.

Planned obsolescence conspiracies make for great spin, but to prove it as in 1+1=2, not so easy. Samsung did try some nonsense, when it was reported they wanted to buy-off some persons note 7 phone, so let's not cast stones.

But whether this has a bearing in the case, we will find out.

Its very very easy to prove. All iDevices are slower on the succeeding version of the OS they are shipped with and the slow down continues till EOL and I have no way of downgrading . This happens only with Apple as with Microsoft and Google, both companies freely allow me to do what I want and therefore they know they cant trap users by slowing down the devices

My iPhone 6 is nowhere near as fast as iOS 8.4.1. .And iOS 8.4.1 still blows away iOS 10.2.1 so you haven't disproven anything

I say "crappy" and shady and you say "ruthless" but I did say I could understand why Apple did what they did. I am just saying they now risk a perception problem or rather, this revelation can feed into the conspiracy theories that float around in Apple discussions about Apple engineering planned obsolescence in such a crafty way.

Yes - they can. Well, to be more accurate they already have. It's sad. But that's the world we live in.

One of the reasons I think Steve Jobs chose Tim Cook was because he has a good grasp on the wider picture. And it's one of the reasons I like him. The problem is, Apple's long term vision of computing doesn't align with many tech types that frequent online tech forums (they want ports, they want upgradeability, they want root access etc.), hence the pretty much ever present anti-Apple narrative.

I did jump over the walled garden. I have an HTC 10 and the somewhat redundant pairing of an S7 and S7 Edge. I prefer my iPhone 7 Plus, sad to say. Lol, I was hoping to like my Android alternatives much better so I could be really immature and thumb my nose at Apple for taking away my headphone jack. And maybe if I still had my Note 7 I might. Maybe. But there were some key areas my iPhone is stronger in vs the phones I do have in my possession. Key for me, not anybody else so I'm not going into that here.

It's always good try competitors offerings when possible, and it's great finding a device/service/whatever that works better than a previous one. I'm a big Apple fan, and I love the synergy between watch, phone, tablet, computer and TV. I love the privacy stance, the resale value, the build quality, use of materials etc. etc... But there are holes which they won't fill. I own a HP MicroServer for my server needs, a Raspberry Pi for my media player needs, and a ThinkPad for my work life. To copy and paste a post I made recently:

"I use a ThinkPad at work as it has an incredible number of ports, very fast CPU and supports some Windows only software that I need. I hate the trackpad, I hate the screen. I hate the weight. I hate the thickness. I hate the boot up time. I hate the fact it doesn't sleep/wake properly. I hate Windows 7. I hate the battery life. But I use it as at the moment I need the legacy ports and the CPU makes light of certain tasks (and I do like the keyboard). No matter how much more I prefer using my 2011 MBP at home, I know getting a MBP for my current line of work would not be a wise decision."

People should just use what works best for their use cases. Is the iPhone works best great, if it's an Android device equally fine.

Yeah I have to do some more work in the mini 4 and see what's up. But I compared it to Samsung phones because people say those need troubleshooting to unclog slowdowns over time, too. I haven't run across that myself, yet except maybe on Apple Music which is starting to lag on my Samsungs running Marshmallow, but my husband says he has on his.

I certainly have had some slow down issues, and can recommend a backup/restore. It's helped me with earlier iOS devices. It's a fairly quick and easy initial step.

YouTube videos can be altered according to you therefore this is deemed not to be evidence. Or is this moving goalposts? However I've already posted evidence that iOS 9 is faster than iOS 8 and imo iOS 10 is faster than iOS 9.

You have to get your head out of this notion of "free". Just because we don't make a separate payment for service doesn't mean it's free.

Basically the price is the price and if you value the service for the price you buy it. In this case the service is one year of hardware support, and software support for 5 years that you do not have to pay above and beyond for. You don't get a price reduction for not availing yourself of the service. Nor do I care from a consumer perspective how apple recognizes the revenue. Price includes the service, whether the phone costs $0, $100 or $1000.
