I don't think Apple with their billions and tons of lawyers will settle in class action lawsuit! Apple will just stretch it out like GM and Chrysler has done back in the 40s. I don't think the law firm will be in business after 10 years of litigation against Apple. LOL!

It might be different in America for example but I think people in the UK could quite easily take this sort of dispute to a small claims court. There are enough examples of this supposed 'bending' and the decision will be at the judges discretion. This doesn't of course mean they have to do what the judge says but they will have the opportunity to settle the case with a replacement or issue a refund. I know Apple are not short of money but this would be a lot less hassle than attending a court hearing. If enough people starting actioning these sorts of disputes it may force Apple to offer a reply or advice on how to limit the chances of it happening. Its all hit and miss at the moment with some people getting replacements and others being frozen out. There should be a protocol now for handling this dispute.

Just to say though that my phone has not bent in 6 weeks and is carried in a tight front pocket. I'm either lucky or not everybody is truthful in how their phones have come to bend. :)
 
Not surprising its there job, I'm not sure there's enough people to warrant a class action suit though.
 
If people phones got bent, they definitely deserve compensation for it. Lawyers or no lawyers.

What they "deserve" is either a replacement or a refund. That's about it. There is no money required due to damages, unless the phone is in an unusable state due to the bending. At which point, you have to kind of question exactly what happened to get it to that point.

Sure, but in many cases Apple refuses to provide a replacement so this is good news

It is and and isn't. The only people that win in class action suits is lawyers. In rare cases it causes the offending company to change it ways and thats where the glimmer of hope exists, i.e., people wish bent cases can get theirs fixed.

Well they need a refund or replacement, why involve a lawyer? They don't get you more money they just line their pockets.

Not if they are responsible for them bending. But that is to be determined and I seriously doubt that could be proven in court that the phone 'bent' with normal usage.

Because some people feel entitled to free stuff, regardless of whether they caused the damage or not. Just do a search for all the threads on here about doing exactly that.

see, that's where people don't get the difference.

if your phone is damaged/smashed if you dropped from second floor of your house. then no.

if your phone is damaged by having it in your front pocket, then hell yes

you're right. my apologies.

at work the other day i was talking to an older, american couple and this very topic came up. they were ranting at this american culture and how it's stupid to be suing everyone for everything.

however, it's not just 'a few', it's the majority.
