Lawyers now starting to troll for Class Action over bent iPhones

Class action settlement will be a $30 coupon off a purchase of a iPhone 10 and for the lawyer millions of dollars #

at work the other day i was talking to an older, american couple and this very topic came up. they were ranting at this american culture and how it's stupid to be suing everyone for everything.

believe it or not, 99.9% of people in US would never sue anyone without at least exhaust other means of solving the issue.

it's the 0.00001% of bad apples that ruin the image for the rest of the people.


same in every country just about everything.

Believe it or not, as someone who lives here in America, the amount of people who sue is far fewer than who don't, hence, not the majority. I'm not really sure where you get your information from but it seems pretty anecdotal & inaccurate. It's pretty prejudiced for you to assume so. And you're basing your judgement on the entire country based on 2 older American? Just 2? ok.

see, that's where people don't get the difference.

if your phone is damaged/smashed if you dropped from second floor of your house. then no.

if your phone is damaged by having it in your front pocket, then hell yes

Sure...but anyone can say that providing the phone isn't competley destroyed.

I understand what you are saying, but that is the issue that this class action and anyone else claiming the phone bent in their front pocket will run into.

There is simple no proof that the phone will bend simply by being in your front pocket.

With this either they get their iPhone's replaced, maybe for free or for a reduced fee (if anything does ever happen) but chances are it will happen again.

Personally I think either it should be replaced or refunded, but you can only get it replaced once otherwise people will just keep getting new iPhones. OR maybe they should offer Applecare for free.

Not surprising its there job, I'm not sure there's enough people to warrant a class action suit though.

If people phones got bent, they definitely deserve compensation for it. Lawyers or no lawyers.

Really. Since when does Apple have to compensate you, or replace your phone for free, after you sat on it (or bent over with it in your pocket and bent your phone between your leg and your hip)?

If it was deformed out of the box somehow, then yes, you deserve a replacement. If you broke it yourself, you get nothing.
 
I love Apple products, but I agree, if there are reports or issues of bending, Apple should stand behind their products and fix it. It's ridiculous that an iPhone can't be placed in a jean pocket because it may cause it to bend. Sorry, but it should withstand a level of pressure. The phone shouldn't be that fragile to begin with. It's no different when placing a MBA into a backpack of books, I never read any reports of the case crinkling.

Placing an iPhone in a jean pocket versus forcefully bending it are two different circumstances.
 
Awesome news. It's funny how many people here pretend like class actions never do anything for the customer. It's like there was't a story on this very site about a month ago where customers were getting $300 checks from Apple's last class action settlement...

Not saying they won't do anything for the customer. It's just that most of them do very little for the customer, but line the lawyers pockets for doing very little work.

I love Apple products too but there is far too many bent 6's for my comfort. First Apple should stop all production and correct there mistakes, secondly replace these bent phones with a good product. Lastly, if putting your phone in your front pocket is not considered normal use, they should put up a big disclaimer in all there stores, affiliates stores, and online for all to see. At least everyone going in would know not to pocket them. Apple needs to stand behind there products.

Because some people feel entitled to free stuff, regardless of whether they caused the damage or not. Just do a search for all the threads on here about doing exactly that.

They'd probably want a monthly pay out/structured settlement for the rest of their lives because they can no longer work due to mental anguish, cognitive dissonance,loss of libido, vague feelings of uneasiness whenever an Apple ad is seen, inability to eat an apple without having flashbacks of their phone bending, loss of familial consortium, opportunity cost of not buying an Android device instead, etc.

Unless the eyeglasses are meant to be flexible, you have to treat them with care. Same with anything that should be treated conscientiously like electronics, jewelry, etc. Jeans=can take a beating; dress pants=not so much unless you want them to be trashed.

If you want a ruggedized phone, buy a ruggedized phone.
 
Well they need a refund or replacement, why involve a lawyer? They don't get you more money they just line their pockets.

Generally you involve a lawyer when the accused is unwilling to give you what you believe you rightfully deserve. From what I have read here, Apple doesn't ackowledge bending as anything more than user neglect (synonymous with refusing to replace).

My only question is whether these devices are bending in pockets. If they are, I would say it's entirely possible they were treated with care, they just bent. I read somewhere that the phone takes 70lbs of pressure to bend, except at the volume buttons, where it drops to 23; that's very low.

To take your analogy, lets say my glasses start deforming after multiple days of use. I am not sitting on them. I am not actively twisting them. They are malforming. I know they are malforming because they don't sit on my face right. Others are reporting this same issue. Is it a problem? Possibly. If it's not an isolated issue, then it may have legitimacy.

People here seem to forget Apple was dinged for their moisture sensor in the 3G/S. They refused services on devices due to "water damage" when it turned out ambient humidity could trip the sensor. There was a class-action lawsuit and they lost. The difference between that case and this one is it took years to get to. This one is what, two months after launch? The moisture sensor case was something like two years, and it came about because, over enough time, enough people were screwed out of potentially deserved warranties.

How dare Apple be held liable for a defective product design.

Alternatively, how dare those affected by that defective product design rely on competent legal counsel rather than appearing pro se.

Not at all shocking. Not every iphone is likely to bend considering they sold millions. At the same time I don't want a product I can't trust to put into my pocket on occasion.

Thanks, I likely will buy something a bit sturdier. I'm currently considering the 5s ATM. My old 4s while sturdy is getting too slow. I really wanted an iPhone 6 so I'm pretty disappointed to say the least. Best of luck to all of you with your new phones.
