Hmmm and how would you prove that the issue was there from the beginning? How would you be able to make a case for a "poor design" 1+ years after purchase?

The burden of proof is for Apple. I’ll make a claim and they have to prove me wrong.

Of course, this is not bulletproof, but the consumer usually wins the cases.
