This is the exact reason I am not going to the Apple store in the Mall of America. I can hardly imagine what it will be like there. The craziest of malls to begin with, added with the i4 release.

I wouldn't be surprised if some folks are in the bathroom over-night.

Then, there's always dressing up similar to the uniform of an Apple or AT&T employee. My friend was able to walk casually into the AT&T store that was lined up around the corner as he "happened" to wear the same color dress shirt and slacks as all the other store reps. Slick.
 
So basically, when they do what you want them to do, they don't create a dangerous situation, but when they don't let you do what you want, it's dangerous, and they should be sued.

That makes perfect sense.

They are not creating a dangerous situation by telling people they can't be on their property until they decide. If people drive around like idiots, that's their own problem.

No my point is there is the potential for a dangerous situation either way, I would just prefer that they have people wait standing at the door instead of in cars. I have absolutely no intention of holding the mall liable for other peoples actions, wether it be something that somebody does while standing or driving on mall property, it just seems like the liability is there either way so why not lean on the safer side of having people wait in a standing line rather than a driving line.

Exactly. America is a lawsuit-happy nation. Someone would undoubtedly sue if something happened to them on mall property while camping out. "You guys should have had more security out there protecting us!!!".

The insurance premiums these places pay are crazy money. The insurance company probably said here is the rules to keep your coverage.

Yeah my point was I could see someone getting in an accident and blaming the mall because they held everyone back till a set time and then opened the gates. I could easily see someone making the argument that the actions the mall took created the rush of cars into the parking lot, crazier law suites than that have been won, so I just don't see the difference in liability.

I hate to say it but I agree, this is a pretty dumb decision and I'm pretty sure that the insurance company would be more in favor of people parking through out the evening and getting in a (semi) orderly line then having an all out dash with people running and cars speeding through the same parking lot.

In one case Best Buy had gotten a very small shipment of ps3's when they first came out. Hundreds of people were waiting outside and they only got 10. Their solution was to put out 10 chairs in front of the store and announce that the first 10 people that sat down would be able to buy one.

The resulting riot and injuries to people that were not even trying to get to the chairs, just got trampled under the mob caused a few lawsuits.

I'm not 100% sure that actually happened, I heard about it on the radio once. But the point remains the same. If the mall puts people in a situation they know will turn out to be dangerous they will be exposed to even more liability.

It's obvious what you must do:

Step 1: Secure a room at the Fairfox Marriott. Make sure to get a room that overlooks the mall entrance so you can survey the scene.

Step 2: Buy a BMX bike that you can use to move around the mall area. Don't spend too much as you will likely have to leave this behind.

Step 3: As 6am nears, be sure to drink plenty of fluids for your trip. An eighth-mile bike ride can be grueling if you're not prepared.

Step 4: At 5:58 exactly, ride the bike to the entrance and be first in line.


Or you could have just preordered.
 
2 big reasons why they don't want people there overnight

1. security, the apple store isn't the only one in the mall, there are other merchants and they probably don't want people hanging out all night in front of their stores during off hours.

2. safety, it is a huge liability to allow people to camp out, if anything were to happen that night there are potential lawsuits from both the campers and merchants of other stores if there is property damage

to avoid the problem the mall owner simply says no camping it is his right to do so

if it is a stand alone store front then they could do whatever they want, but apple is renting space they don't own it.

and just to let you know you can go to jail if you're caught on the property, it is trespassing since you are on private property and aren't suppose to be there. so if the security felt like being hard on you they can call the cops out and have you taken in

anyone going though that much trouble to have a phone a few hours earlier than everyone else needs to have their head examined

I was thinking the same thing except parking at the "Fair Oaks Dental Care". It would look like you have an appointment and you could make be heading towards the door while others are coming into the lot. Definitely going to need some ninja skills. good luck.
