You could by an OS-X Gateway or a Windows Vista Gateway
if this happened. Apple would increase their OS market
share, but because they would lose some market share
in their hardware, their profit would dip way too low.
They still could end up doing this, however, if they made
a good plan and marketing strategy, so selling retail
box sets of OS-X is something to look for in the future.

The best strategy would to limit the operating system to new PCs using the same EFI implenmentation as Apple. No BIOS. This would make it easier on Apple and isolate Microsoft. The only real expansion of drivers needed would be Chipsets from Nvidia and AMD/ATI and if they wanted it, it would be their responsibility to send people to Apple to help get it done.

i dont understand how this would be illegal at all. as long as the person buys a copy of OS X.

I believe its in the license agreement that you will only install on Apple Hardware. Something like that anyway.

You can't buy a copy of MacOS X for Intel processors except by buying an Intel Mac, so it is at least $599 for a MacMini.

The MacOS X 10.4 for PowerPC that you can buy is de facto an upgrade. It doesn't say so on the package, but there are no computers that you could install it on that didn't come with some version of MacOS originally. When Leopard ships, expect the box to say "UPGRADE FOR EXISTING MAC OS X USERS ONLY".
