See if they will replace it. The machine should come back the same way you sent it in. All be it repaired...

I'll see what happens when I finally receive the call back.

California has the strongest consumer protection laws in the entire US, so I'm definitely going to let them know again that I am well aware of my rights here and they can't screw me over.

The sad things is I'm not even surprised. It came back exactly as I thought it would. My only surprise is that the mouse button is actually functional this time around.

Well here in Ireland Apples customer relations seem to be pretty good. And very very helpful. I got phone calls every 2 days telling me of the repair status. And then when they messed up the repair they just said ok we will replace it. No hassle what so ever.

I know some people have bad complaints about Apple care. I have none.

But their repair companies they use are s***e!!

Left side on Macbooks always seems mushy.

I actually saw a thread about it here awhile ago. So I tried pressing on the left side of mine and it wasn't mushy.

But where the second screw is (farthest from the front), it pushes in so far that I feel enough pressure would cause it to break.

Theres also the front, above the battery, that now feels like a mouse button and even clicks like one. I guess I have the first Mac notebook with 2 buttons

It'd be nice if they said that here. I'm still waiting for my call back.

We'll see.

I'll give him another call in a few minutes if he hasn't called me back.

I'm sorry I didn't add this earlier but the left side over the ports has the same "mushy/crunchy" feel just like the area over the the IR sensor.

Well, like I said, my 2 never will. Judging from posts on this forum that I've read, its certainly not something that everyone has either.

But being "mushy" to the point where it seems like it could break with enough pressure is definitely not a good sign.

Just left another voice mail for Ken Bell.

I had the MacBook on for half an hour

The left quarter of the screen is now not evenly lit. It also has a slightly blue tint and its washed out.

Flextronics really did a job on my MacBook!

Before, it had a brilliant screen. I was happy when I received that system as a replacement because the screen was evenly lit and beautiful compared to my first MacBook. But now it looks worse than that one did.

Ugh. If Apple doesn't offer to replace this system, I will *never* buy another Apple product again. At all. I'll even cancel my iPhone.

Finally received my phone call. What a jerk!

Basically, I'm sending it in for repair one more time. If it doesn't go good this time then they'll refund it.

Several times he tried to tell me it was "cosmetic issues" and that Apple was doing it out of "customer service". I had to remind him that, legally, under California law, Apple is responsible for any and all damage caused during their "repairs".

He even tried to tell me my previous system, with the defective mouse button and optical drive that was made unable to read discs by Flextronics, was replaced "out of customer service".

I had to remind him numerous times of California Civil Code 1750 and that Apple was not doing it out of customer service, they were doing it out of legal obligation.

Seriously, what a jerk.

So anyway, we'll see how things go.

He even had the nerve to say "thats what you've been after all along, right?" after he mentioned the refund. I told him no. I liked the system, despite OS X being overrated and not being able to do what I like it to do, I do like the hardware. It's small, portable, and gets great battery life. I want to keep it. I just want it without issues.

Seriously, that guy was worse than Roy Herrara over at HP.

OS X overrated? Ouch! That was below the belt, try to keep the gloves up.

God hearing the word Flextronics makes me cringe. They managed to mess up basically every repair. After about 4 in a 2-3 week period, I finally got a new MB. They seriously destroyed my iBook. It was in perfect condition for 2+ years and once I sent it in, came back beaten up and the screen bezel was coming off.

How many repairs have you had? If this is your 2nd time you really shouldnt be complaining. If you have had 5+ repairs then I would say "Can I just get a new machine, I am a student at college and I need a new machine for work."

Haha. Well, he asked if I had any other problems, so I told him that and that OS X crashed a lot more than it was advertised to. I'm not going to lie.

Well, keep in mind, the system in question now is the replacement for a system that Flextronics destroyed ;)

The first one went in for discoloration and a bad optical drive. It came back scratched up with a defective mouse button and the optical drive was not touched. It went out a second time and the casing was replaced, but scratched anew and the optical drive was "re-aligned" and rendered unable to read discs. Plus the mouse button still didn't work.

So I've essentially had Flextronics mess up two systems, one of those being the replacement for the system they originally messed up.

And my only REAL problem with Leopard is still DVD Player. I love watching movies. But even in Leopard, DVD Player doesn't cut it. The image quality is still bad and the software still can't decode the LFE channel and send it out through headphones or to speaker sets without 5.1 channels.

I truly do want to keep the system. Even though I don't use it very much any more, it is a very good portable computer. It's light, its strong (unless Flextronics messes it up), and it has good battery life. I do truly want to keep it. I'm not pushing for an upgraded replacement either. I just want that one fixed.

Well...if they repair it and it still has problems...take them to Small Claims Court. I am going to be doing the same thing with Microsoft over my Xbox 360 if they do not give me a new Xbox 360. You see...Microsoft loves to make you wait. I sent my 360 in for repair in December, got it back in January. It broke 15 days later on Jan. 15th. The repair center just got it and they said the repair time will be 2-3 weeks then add 1 week for shipping. So basically I havent had an Xbox since December. I wrote them a letter requesting a new system or I would take this to Small Claims to get a new system or my money back. It sucks.

Flextronics has a contract with Microsoft to build the xbox 360 :(

I had one that I re-sold...

I had one that I re-sold that had the same thing happening to it. I squeezed the parts to gether, they snapped, and all was good. The display frame was loose too and it snapped back together perfectly. I never abused it so I couldn't figure out what happened to it but it all snapped back together fine. Odd... It was a black one. Nice system. Wish I had it sometimes because it's smaller to carry than a MBP.

That does suck. You definitely have every right to take them to small claims court and you should win.

I might have to consider that with Apple. I don't really want to. Despite the negative things I've said about my MacBook and Apple in general, I really do like the MacBook. It's small, light, gets great battery life. The only issue I truly have with it is DVD Player not being a good application. I love watching movies and DVD Player just doesn't cut it.

I just checked and California is one of the states that does not allow attornies in small claims court and service can be done by registered mail. So theoritically, I could send a registered letter to Steve Jobs telling him I'm suing him personally. haha.

I truly don't want it to come to that though. I'm not looking for a refund. I do want to keep the system. I don't want an upgrade. I just want this system back in the condition it was before it was sent out, minus the separating case and bulging battery. The battery has been taken care of, now they just need to fix the scratches and fix the case so its as strong as it was before sending it out. I mean, seriously, the left side feels like it could break and the area under the indentation on the front pushes in easily. It was a strong and sturdy case.

Is that too much to ask for? :(

Ack! I knew they had a contract with Microsoft to build the new Zunes (which instantly killed my interest in them), but I had no idea they built the Xbox360 too! Looks like I just might end up getting a PS3 because of that, even though I think the Xbox360 is the better platform.

Thats why I want to keep it. The size is just about perfect for a full featured computer.

The case is sturdy as well, when assembled properly.

I don't want a refund or an exchange. I just want my system back in something resembling decent condition.

well im having the exact same issue as you are, bulging battery and splitting case, i also have a high pitched noise coming from the machine and the left side is very.. 'mushy'.
i only hope my repair process doesn't go as horribly as yours does.

Good luck :( You're going to need it.

If I were you, I'd certainly look into the consumer protection laws in your area before sending it in. Try finding an Apple Authorized Repair Center in your area too.

If I do end up keeping my Mac, I'll be sure to take it there, no matter how far the drive, from now on.

Well, I just wrote an email to sjobs at apple.com. I was very polite and tried to be "professional". I explained that I don't appreciate having my intelligence insulted (you know, telling me that a SuperDrive that can't read or burn discs is "cosmetic") and that I don't like being indirectly accused of trying to scam Apple out of a refund. That if I didn't want the system, the purchase would have never been made or I would have sold it long ago.

I explained that I'm not out for an upgrade via replacement, and that if Diana S. had offered a refurbished replacement the first time around, I would have been perfectly fine with that.

I explained that all I want is to, of course, not deal with a jerk any more (but not in that way) and I just want my system restored to its previous condition, minus the case separation and bulging battery.

We'll see how things go. Though I am tempted to call through AppleCare and get somebody else to take care of things that way.

Received a call from Nate Doss this morning regarding the email I sent to sjobs@apple.com last night.

Pretty quick response!

Unfortunately, I had my iPhone on silent and missed the call

Waiting for the call back now.

Wow what a difference. Received the call not too long after making this post.

It's amazing how different two people can be. Yesterday I dealt with someone who made Roy Herrara over at HP seem like a saint, and today I dealt with someone who was actually nice, polite, sincere, and seemed like he actually wanted to take care of my problem.. not somebody who is insulting my intelligence by trying to convince me a defective optical drive is cosmetic, or accusing me of being after refunds almost a year after I made the original purchase.

So the system is going back in for repair, as I had agreed to. He took notes on everything that Flextronics did to it and what needs to be fixed.

The treatment was basically the same treatment I had come to expect from Apple after dealing with Diana S. A good experience.

Now the wait begins again. I really do want this situation to work out. I honestly don't want a replacement. I just want THIS system fixed.

My story...

Maybe this gives you some hope...

iMac BTO, just over a year old. The HD dies. I take it to nearest Apple store to get it fixed. End up buying ProCare with the assurances that if I spend that extra $99.00 I can get it fixed in days rather than weeks. I buy it. I do web design and need my system fixed, soon.

Nearly 4 days later I get the call: System fixed, come and get it.

I get it a day later due to weather. Start long process of restoring. The HD fan is running at top speed. Nice... I figured that after reloading everything that it would slow down. Nope. The sound is very irritating, itunes can't cover it up well.

Then while working on a page I notice a 'dirty spot' on the screen. I wipe and it doesn't clean up. I use screen cleaner and it's still there. Perplexed, I get a good look at it. It's like some kind of glue smeared on the screen! Nice... Rip a cd to itunes and the disc won't come out. Nice x 2...

Call AppleCare and after being led through an SMC reset which now makes all the fans run at full speed and SMCFANCONTROL won't run either I get told to 'bring it back to the Apple store. It's over 2 hours away and I don't have the warm fuzzies from my last experience. I request onsite service. Next thing I know, I'm getting a call from Apple. 'You are unhappy with your recent service experience'. Uh, yeah... 'Well, some of the parts that your system needs are in long term back order so we would like to offer to replace your iMac rather than have you wait for what appears to be a long time for the part(s) to come in'. Well, ok. Lets replace it. I got the 'we'll send one out when we have your system in our possession' line but bit anyway. The replacement shipped the day after FedEx had mine. That next day I had the replacement.

I'm a happy camper. I felt used and abused and wasn't happy with Apple 'support' but I now feel like I got more than Dell or HP would have done.

I wonder if it was the ProCare that helped grease the process or what but I now have a nearly totally spooky quite iMac that sounds like music to my ears!

Thank you Apple service. I'm still not comfortable with the local Apple store service people but the company stood very close behind their product and in today's times that speaks very loudly.

What was interesting is that their 'on-site' support is only for people within a half hour of a service provider. Doesn't make much sense. That is one thing that Dell, HP and even Sun will do. If you have a valid contract they will dispatch parts and a tech to your location, wherever that is.

Get AppleCare. It's worth it... :apple::apple::apple:
