I’m curious who the knuckohead bean counter/patent lawyer advised Tim and the board that it was cheaper to just poach the workers rather than buying Masimo or at least getting into a cross licensing deal with them. If Apple just outright disable the pulse ox or cripples with updated firmware, you know the class action lawsuits will start to fly.

Apple will just need to update newly released hardware to comply and software updates to support the new hardware. Temporary setback.

If it were so easy, Apple wouldn't have gone down this path of hardware and software design in the first place.

Much posturing from a patent troll.
They are not a patent troll because they have products and a real business to lose, but most companies don’t enforce these types of overly general patents because it starts Cold War tactics where the other side unleashes their defensive patents.

It sounds like activist investors haven’t been happy about Misamo business decisions and this may continue to make their investors angry. I don’t see what Misamo has to gain. They are not going to get a cut of Apple Watch profits and they may have painted a target on themselves.

It isn’t the algorithm they want licensed. By licensing they would probably want to sell complete systems (i.e. completely design the sensor and software in the Apple Watch) like they do with their licensees and take a hefty cut. I don’t think Misamo does typical IP licensing. Obviously Apple wouldn’t be onboard. Apple might also take this on principle since the patents in question are the sort that are usually used defensively except by patent trolls.

If we take the CEO's words as truth (I grant he could be lying). Apple hasn't even engaged in licensing/settlement discussions. I'm pretty sure Apple with the amount of money they have could negotiate a license agreement. Of course the terms won't be favorable now because they waited too long and it's assured (short of Biden saving them) that the product will be banned from sale. They are now in the worst negotiating position.

On it's face it just seems to be a gamble Apple took and lost, but at the end of the day everyone has a number. I'm gonna bet Apple Watches will be back on sale very soon.

I’m sure Apple wasn’t planning on being attacked by an overly general patent. These are typically used defensively. Misamo is playing hardball since it makes them fair game to attack their products.

The whole point of Apple having a $1B legal budget is to enable Apple to operate using high risk strategies. Skirt the law whenever possible and overwhelm the competition with prolonged litigation. In the long run, it's supposed to be cheaper than actually licensing patents and doing it properly.

There is more to these stories than outsiders will ever know. It would be foolish for anyone to draw conclusions at this point. Each side has their own version of the story. The side that uses the media to amplify their version is usually the desperate one. Just look at Epic — how much of what Tim Sweeney has been saying is actually true? How much truth was bent to support an argument?

Apple can change their hardware to comply. They don’t need to settle. What Misamo has done is made an enemy.

I wonder if Apple knows their software work around isn’t valid and they’re just doing it to further drag out the litigation.

Indeed Apple has sued Masimo too.
I trust that the ITC and courts have done their due diligence, and they have both ruled against Apple.
There was a mistrial in federal court. Appeals yet to come.
 
The way this has been described -- Apple pays Masimo a visit, talks about a partnership, then suddenly several key Masimo employees are working at Apple reinventing Masimo's wheel -- feels absolutely like something our Apple would do. Apple is so addicted to high margins that it's practically allergic to paying up for things it wants. Remember how they pay ARM thirty cents per chip?
People may laugh at this description but this is exactly what they did to a company I went to work for with the Nike foot pod that they introduced back in the day. Completely ripped off the entire design and software under the guise of acquiring the company.
