I would suggest that if you're really into Apple, you should also read about an expose yourself to other parts of the computer industry, to have better perspective on things.

My question to you is why didn't Microsoft cry foul long before the App Store had any success? In fact, Apple announced the App Store weeks before it went into business so Microsoft had a chance to say something then, they didn't. Why?? Again, if Apple's App Store wouldn't have had any success MS would've kept their mouths closed. It's all about jealousy.
 
And I hate Microsoft more than anyone here probably, for reasons that actually make sense (not "Windows suck because of viruses!"). Yet here I am and "siding" with them on this issue.

Seriously, remaining objective is so easy, it's a wonder people around here have such an issue with it, especially when it comes to Apple. Your Mac isn't going to catch fire because you don't agree with Apple all the time.

Why would Microsoft complain about Apple calling their store the App Store? They are "fighting" to say that Apple and EVERYONE should be able to use the App Store.

It's not about jealousy at all. It's about fair use.

So I "get" Apple has been on this Trademark since 2008 and Microsoft just remembered it was going to join the bandwagon, I mean join the App club soon with WP7 in 2010 (2 Years later).

So it's not granted, it's now in the opposition phase of the grant approval ;)
 
Exactly. It wasn't until I started using OS X, that I really starting calling my 'programs' 'applications.' Even in the old days of Mac operating systems, they were always programs. Apple is really who popularized Applications and Apps. I'm not saying they created those terms but they are largely responsible for their use.

Well, take a look at the "Task Manager" in Windows. It has been referring to these "programs" as "applications". This would be like Microsoft trademarking "Operating System" instead of "Windows". If Apple wants to call their apps something like "bananas" and make a "Banana Store", I don't think anyone would object.
 
Yep, that's exactly what this is all about in the end, it's Microsoft wanting to name their future store just what you said, it's not about using generic terms, it's Steve Emballmer's own jealousy of Apple's success and MS's lack of exciting their customers anymore. It's bad enough they had an extremely lackluster appearance at CES.

Haha, I heard Microsoft plan to sue Apple again and name their store the Microsoft Apple App Store and their next OS Microsoft Windows Snow Leopard OS X. That's what's it's all about.

Exactly, Apple can call their store whatever, as long as they don't infringe someone else's trademark. The issue here is not what they do call the store, it is trying to trademark the term.

This is about trademarks, and in trademarks, there are rules about descriptive terms and generic terms. Sorry App Store doesn't respect those rules, maybe Apple should have thought about that before naming their App Store... well.. App Store.

I bet that indian is just as pissed he can't name his convenience store "Convenience Store" and trademark the name.

Indeed. I do not fault Apple. If this went uncontested or even now that it has - and they win - it's a good win/trademark to own.

But they know, as does anyone who reads anything about trademark law, that it is so incredibly "nebulous" of a trademark application in the first place.

Again - for Apple to try is GREAT, interesting and bold. But that doesn't mean it's legit. And that's what the petition process is all about.

I agree with Apple on principal. They developed a recognizable brand and product, a name for which has never been used by anyone. Now, with it's market presence, others want to capitalize on the enormous capital Apple has invested in the brand. It is a short-cut to greater success for their own products.

I like Apple, because, in their phone and computers I see a top product. Similarly I like Microsoft for their XBox 360. They have THE best (IMO) game system, in particular because of its "Live" integration and "Marketplace". Two other generic terms that they have developed and expended massive capital on. They should be equally protected. But hey, "Live" has always referred, in the world of media, radio, tv and streaming to the same "immediacy" of broadcast/connection. Yet, even that word is protected by Microsoft. But I think it is fair, because they coined it's use, relative to gaming.
 
Uh, "Apple" anyone??? (And they even had to pay A LOT to the Beatles to be allowed to use that name...) Or "Pages". Or "Numbers". Or "Keynote".

Besides, it's about trying to get a trademark on something as trivial as "clothes store".

The box store and the container store are active trademarks for stores but again I don't think these things should be but they are
 
M$ is right about this one, the term "App Store" is too generic, and should not qualify to be trademarked.

But here's the rub... It's too damn easy to get **** trademarked (or patented). If "App Store" should be denied a trademark, then so should "Windows", which is even more generic than "App Store".

Yet again it needs to be pointed out MS does not own a trade market on Windows.

The own trademarkets on "Microsoft Windows", "Windows XP", "Windows Vista", "Windows 7", Windows Phone 7"

I put quotes over the entire trade mark but noticed the bold words. Those are words other than Windows in each of the trademarks. With out those extra bolded worlds it is not a trademark volition.

Apple could trade market "The App Store" but they want App Store because they can stop anyone from using that generic and good description of it and "The App Store" would only be in volition if they used the name "The App Store"

Now if you use Windows in MS font then yes that is a breaking the trade market but it requires a lot more than just the word Windows.

Irrelevant, the patented term is "windows", which in the "sense" of computer operating systems is patented. the "App Store" in the sense of a computer software distribution platform was coined by Apple and had NEVER been used before Apple brought it to the market place. The fact Apple have been trying to patent this since 2008 says a lot, where were the objections back then before Apple had this massive success on their hands - and why has it taken Micro$oft a year to object?!

And before more idiots - who somewhere along the line - forgot to read the original story, Apple is not looking to patent the term "app" or "store", it is looking to patent the phrase "app store" Anyone care to give an example of anyone before Apple using this phrase, or anyone else even providing a similar service back in 2008 when the application was made?

Does anyone care to give a decent reason why Micro$oft have waited until now to complain?

Actually, Microsoft complained about it in July last year. Might want to read the article before you comment on it.

I understand that. I said that because if everything becomes fair use what's the use for trademarks, patents and copyrights?

That's my point. Apple didn't invent the word but they are the ones who market their store as "The App Store" - It shouldn't be fair use because no one ever marketed their app stores as just "App Stores".
