if he's not that smart...say you have the IMEI number and you going to call it in as stolen...explain to him that once you do that, the phone will not accept any sim card and if its attempted to do so, the cell company will report it as a stolen device.

I wouldn't bother. This doesn't get him the phone or the money back. Besides, he'd just sell it.

Good plan. I used to use ebay all the time back in the day. My account was created in 1999. But in the last few years everything has gone to hell. Illegitimate sellers started ripping people off left and right, sending buyers for the hills. So ebay revised basically all of their policies so that it's so one-sided it's absurd. They rule every discrepancy in favor of the buyer. I guess they thought it would be better for business if the buyers always felt safe. Unfortunately now the only people who can sell anything are power-sellers with an established reputation. The days of normal folk like you me being able to make a quick buck selling something every now and then are gone...

Of course, that's just ebay. There are alternatives, albeit much less known and therefore not as profitable.:(

The UK 2G box did actually have the ITMS app on the box, but it was on the other side of the home screen.. anyone remember that, when that little icon was on the right side of the screen? Dunno if this box ever surfaced in the US though...

No box had the ITMS on the left side of the screen like the screen cap suggests.
 
I've requested that he send me high resolution pics of the shipping packaging and all sides of the "empty" box.

I feel for you op. I've recently decided to shut my eBay account as I never do feel safe selling on there (273 positive feedbacks since around 2002).

Such a harsh lesson to learn but I hoe you get as much back as possible.

Hopefully everything works out for you. I sold my 3G 2 weeks before the iphone 4 came out and didn't have a problem. I sold it to someone in the US though. I'm curious to see how your situation and the other person i read about make out with this. It is crazy that you can't really trust anyone anymore. Best of luck to you OP.
 
i called ebay, and they said to take pics during the packaging with a time/date stamp on the picture and they will use that as proof and side with the seller. Has anyone done this?
