To clear things up, I DO deserve a brand new one, as it was bought brand new with a faulty screen that was due to no mistake of my own.
I'll restore my iPod, put my music back on and then get some proof pictures and videos that will help show the problem. If the genius doesn't give me a NEW one then I will talk to the manager and raise my voice
