Not at all. Good for him, he got lucky. What i do have a problem with is his misguided sense if entitlement. His legal right to a new phone had expires and he still argued that he should get one. He had the option to buy apple care and extend his warranty but didnt, and then claimed that O2 owed him a phone. His attitude towards the whole thing is what bothers me.

Why spend more money on AppleCare when you get the same broad levels of protection under the act, for free? All AppleCare really buys you is the convenience of quickly and easily getting your phone repaired or replaced. You can get the same result under the sale of goods act, it's just harder work since you tend to have to write letters and make complaints. What do you mean by misguided sense of entitlement? The OP *is* entitled to have the phone repaired or replaced as it has broken down before he should reasonably expect it to do so.

QFT.

SOGA is one of the benefits of living in the UK..saved me a fortune!

For those that don't believe the OP, why not just Google it? What's the point of arguing and arguing when you could find the answer quicker on your own? I don't get it.

For example:

The important point about warranties is that they should never seek to replace your rights under the Sale of Goods Act, and even after they have run out, you will still be protected by these statutory rights which can run for up to 6 years after purchase. - http://whatconsumer.co.uk/is-the-guarantee-worth-the-paper-it’s-written-on/

If the retailer or manufacturer’s warranty has run out, the shop is often quick to say there is nothing they can do before attempting to sell you an extended warranty. This is misleading. If you buy something which should last 7 years but breaks down after a year and a day, you can still claim it was of poor quality in reference to the durability aspect. In this respect it will help to know how long items such as washing machines or printers should last. You can get this information relevant trade association - http://whatconsumer.co.uk/how-long-should-it-last/
