If I were you, I would take it to an Apple store straight away, although they may tell you that you need to return it to the reseller because technically it isn't a warranty issue, but then I don't know much about Apple's policy.

However, from experience, if you don't return it, and you experience problems with the laptop further down the line, Apple may use that 'ding' to blame the fault on the laptop being knocked or dropped or something.

Just to clarify; i am UK based. The ebay reseller purchases direct from a distributor in NW9 and he is a platinum PowerSeller trading since 2005 with over 5k feedback selling all kinds of top of the range/ expensive gadgets.

I think the MBP is legit enough!!

To the people who think damage out the box to an expensive brand new laptop is acceptable and feel the need for insults? GROW UP. I dont have money to throw around. Maybe you

Ok. Stop right there
Who do too talking to GROW UP??
Just because people disagree what you want ?
Boy, you should GROW UP

whether I can just return to any store.

No you can't. Your contract is with the seller.

What happens in this case?

You return it to the seller, and you are entitled to a non-damaged replacement. In the event that a replacement cannot be provided, you are then entitled to a full refund.

The seller will return it to Apple so that he/her/they are not out of pocket as well.

And just for the record, I wouldn't be too pleased either. :)

If I was you I would just keep it and use it. As long as it runs as it should then all is well. I know that I wouldn't be happy with it but it's nothing major. When I got my blackbook a year ago the case was slightly loose on one side. Sure I didn't like it but now I never even notice it at all.

Just consider it a 'beauty mark' and know that no one else has one just like yours. Now go and enjoy your investment.

Bearing in mind this comment I am sure I will get over the minor defect once the MBP comes 'alive'

However I never really looked at it that way.
Thanks for that Gaz!

I might just go and find out more about Apple's warranty policy anyway. Nothing to lose with trying.

iGav is right - you need to return it to the eBay seller, as your contract is with them. If you take it to the Apple Store Bluewater they'll just tell you to do the same so don't waste a journey.

If the laptop developed a fault later on then you could take it to Apple, but this is different as you've only just bought it.

wow

i wouldnt even think to keep it for a second, as far as i know apple are really good about warranty no matter where you bought it from still apple product, return it to apple store , if they wont accept it call them and i'm sure they will exchange it for you

Im sorry, but if you are paying $2,000 or more for a computer, then it better come in nothing less than pristine condition. It is clear that something happened while this computer was in Apple's hands, and that the dent was not induced by the consumer at all.

I can understand why you might find people that complain about every little scratch annoying (particularly the self-induced ones), but this one was clearly done during the manufacturing process. Lets change it from a less-noticeable dent (although this is clearly noticeable), to a deep, noticeable scratch along the top of the casing. And lets say that this scratch was there when you opened the box, so there was no way that anybody other than Apple caused this: would you have absolutely no problem with that scratch being there? I know I would.

When you are paying more than $2,000 on a computer, your computer should come in absolute pristine condition. Paying that much for a device definitely makes it a premium product, and nothing less than that.
Ditto, it was like that right out of the box. I would return it too.

I agree with the other posters. Although it is a tiny defect, a $2000 machine should be flawless. Return it and sleep easy..

While it is a fairly insignificant nick, you are paying premium prices for aesthetics. Apple will not care about refurbing this; someone will get it with a new body; the old body will go to get recycled; a statistic will change on the scrap rate; a family will go without rice for a day.

If you didnt buy direct from apple then good luck exchanging it, apple will gladly take it back but not if you purchased from a 3rd party (Same think happened to me)

Now I may be dead wrong with this, but I believe that the warranty still carries on through a resale, I think that they may be legally obligated to do so, but as I said, I may be dead wrong with this, and if I am: somebody please correct me and everybody disregard what I just said.

Anyways, Fauldzy, did you attempt to bring it in or contact Apple? Instead of digging through books of fine print, why not just give AppleCare a call, explain the situation, and see if they will cover the damage. I think that getting the information from the company itself will be the most definite and direct source of your answer, and if you do, please share it with us here, that way we all know for future reference.

Well I went to my local Apple branch today and explained my situation in full to a 'Mac specialist'. Funny enough before approaching the shop assistant I took a quick look at the unibody's which they had out on display and at least two had a very similar chip on the corner edge but in different locations. That made it very easy for me to show the assistant exactly what my issue was. (initially I decided to leave my macbook in the car and just inquire)

My conversation kind of went like this:

Me: "Hi, yeh I bought one of these unibody macbook pros just yesterday and on inspection of the laptop with the plastic seal still intact, I discovered a chip on the corner edge, very similar to the ones you have on display in store here. Look."

ASA: *nods* "ah yes"

Me: "well I was wondering if this was covered under my warranty?"

ASA: "Yes, thats no problem, we can swap it right over. Have you got the receipt?"

Me: "No sorry"

ASA: *looks vacantly* "Did you pay by card?"

Me: "erm, no"

ASA: "Ah thats ok we can trace your purchase though your serial number"

Me: "I didnt purchase here"

ASA: "OK, where did you?"

Me: "A reseller"

ASA: "Oh well im afraid in this case we cant do anything unless you book it in to a Mac genius for repair. I suggest you take it back to the reseller"

Me: "Ah ok. So as it stands, my 1 yr Apple warranty, am I still covered by you? What happens if say something else was to go wrong with it, am I still covered by this store?"

ASA: "Yes, you have purchased an Apple product so you will still be covered here by your warranty"

Me: *puzzled* "OK, thanks! You have been been a great help"

I dont think the Apple shop assistant seemed to grasp the fact that the laptop had damage under the plastic seal. Looking back I wish I had made this more clear. So anyway bearing in mind the hassle it would have been to trek across the other side of London again to the original reseller, I broke the seal.

Still not sure if I did the right thing or whether I should have persevered with replacement? Its nothing major, I can deal with it haha but it does pee me off. That said & true to my assumption, as soon as the MBP came alive for the first time, WOW!

In comparison to my now dated PowerBook 1.25ghz from 5 years ago. Amazing! Smaller, smarter, faster, brighter! The only real niggle I have is the super glossy screen; its not really very practical. Admittedly in the bright lights of the Apple store on the display models, reflections were a lot worse!

Well I hope this thread proves helpful and sheds some light for others in a similar situ.

Thanks to everyone (again) for your opinions, I mean that. Yes, even the ones that were not so constructive. Oh and just for the record i am not gay and I didnt cry!

I suppose I just have to come to terms with my defect now eh!?

I HATE HATE HATE!!! This excuse. It set's off a sleeping lion inside of me and want's to make me go berserk. It's a COMPUTER whether it be from Dell,HP,Apple,Lenovo,Chinatown,Japan,Germany,Brazil there ALLLLLL made in the same location... Of course Apple is ripping you off with 200% markup's but hey it was YOUR decision. Your buying one of the most expensive OPERATING SYSTEMS (Which is 100% worth it.) not a monster computer. Live with it, if it dosen't work return it. Simple as that.

I feel better.

Why didn't you say you bought it off ebay. Ask the Ebay users for a copy of the receipt and to just block his payment information out. Your obligated to a receipt. you should say you bought it off ebay man otherwise this guy is gonna think you bought it from bestbuy or somthing.. lol

why, take it back let them check it through the serial number, your computer has a serial number, its the 1yr and tell them its brand new and this shouldn't be like this. Since you opened it, you may have more problems but I have bought ipods other places and got them swapped at an apple store. They will handle the warranty under your serial number. You will have to make an appointment with the Genius bar but thats no big deal, schedule one and tell them what the problem is then go from there.

You payed for this thing, it should be in good shape and if this bothers you then take it back. yes when apple notices dings on the computer when you bring it in for other problems (if you do) they can see that ding and say sorry you voided your warranty. I suggest take action, it doesn't hurt.

yeah i have a problem with your anger. It makes no difference where the computer is made, the fact is its damaged and he can complain about it because it shouldn't be like that brand new. You pay the mark up for the OS and the ALUMINUM CONSTRUCTION and the SERVICE they provide. That's your premium so take advantage of it, you paid for it. I would complain if I bought a shuffle and it had a chip in it, but its a little more frustrating when you pay a couple thousand for a device thats damaged. I'm glad you feel better you just ranted about nothing, and your points made no difference to the situation or even helped the OP. And if you want to live with it thats your decision. My power button is all goofed up and I have lived with it, but hey I got applecare so it makes no difference if i go in today or a year from now.:D

It makes little difference where you got it. If the computer is registered to you with a valid serial number the 1yr warranty is a MANUFACTURER warranty. Who makes it, Apple, who can you deal with Apple. Its not the sellers fault he got it damaged from Apple. Which seems to be the incident.

Wow, I set off all that? I feel kind of proud figuring my not so loud words set off a near explosion...haha. Back to the point, are you trying to say that he should just plain and simply deal with the dent? Because I'm sorry, but I don't care how much I pay for something, if it wasn't purchased used, refurbished, broken, worn, or anything of the sort, then it should come in nothing but pristine condition. If a cheap windows laptop that I paid $400 for from the store came with a dent on it out of the box, then I would return it, or try to get it fixed. If you didn't cause the damage, then why should you have to pay to have it fixed? This damage was clearly caused by Apple during the manufacturing process, so why should the owner have to pay for, or live with the damage when the product was not sold with a description stating that the product was damaged (and don't try to flame me saying that this isn't damage, because it is, no matter how small).

Listen, I own a mac I have no rant's I own applecare as well. It's just the OCD people set me off I guess. Now i did mention a little somthing in my post to the OP, useful advise i think.

IM telling you that they will not replace you mac because of a cosmetic issue (only because you did not purchase it from them directly online or instore) , yes they will have warranty and cover your mac for repairs but not your case. even if you will make the appointment with them.

If I were in this situation, three simple options.

1. Return to eBay seller.

2. Give AppleCare insteadvwasting your time just to get same answer.

3. LIVE WITH IT

I also have a small ding on mine , ordered mine straight from apple. The thing is though I went through a lot to get mine the apple store people did not know anything, I drove there and they said they had the MacBook Pro I wanted then they didn't then the other guy did then I filled out the credit app and then they finally did not have it and told me the 2.8ghz was special order only from online so I had to go home and i ordered it and it took a little over a week to come in. Then finally when it came in didn't you know a little ding on it, I was going to return it and try to get another one but if they took it in until the new one came in I would need to wait maybe another week or long so I just did not bother. I am getting a cover for the whole laptop anyways, I want to wait for incase to have them to see if they have each port cut out if not then I might just get the silk on on apples site
