I had an original iPhone, but I replaced it with an iPhone 3GS. However the old one has a problem with sound that I'm sure Apple can replace. Thing is, will Apple replace it, or will they not allow it since it is not under a contract?

They don't check contracts. I had an original iPhone replaced by an Apple store that wasn't hooked up or under contract.
I will gladly purchase it from youim looking to buy one and i havent yet found a 2g iPhone
It already has a new owner. It's for her birthday.
I should've checked the warranty anyway, I feel so stupid.
I'm also getting her a $40 cake in the shape of her car (she's obsessed with it haha).
But, anyway turns out it's out of warranty. I had it replaced around end of February, so it's a little over 4 months. I thought replacements had a 6 month warranty?
