I had an original iPhone, but I replaced it with an iPhone 3GS. However the old one has a problem with sound that I'm sure Apple can replace. Thing is, will Apple replace it, or will they not allow it since it is not under a contract?

Depends if you still have warranty coverage on it
 
They don't check contracts. I had an original iPhone replaced by an Apple store that wasn't hooked up or under contract.

It already has a new owner. It's for her birthday. 🙂

I should've checked the warranty anyway, I feel so stupid. 😛

But, anyway turns out it's out of warranty. I had it replaced around end of February, so it's a little over 4 months. I thought replacements had a 6 month warranty?
