That depends on how they do it. If they somehow got iTunes to think it's a genuine iPod, there's no way that Apple could stop the pre from syncing without issuing a firmware update for EVERY iPod ever made, which puts Apple in a tough spot.

If that happened then there are definitely some IP issues happening.

If iTunes thinks the Pre is an genuine iPod then the Pre software is doing something it shouldn't be doing and that is a problem. Apple wouldn't have to do anything but send a letter to Palm from their lawyers and the Pre would magically get a software update and now for some undocumented reason it no longer sync's with iTunes.
 
Wasn't Apple taken to court over making iTunes incompatible with other players or was that for making the iPod incompatible?
 
there are many software out there that handles iPod, and its hard to imagine Jon and Palm would act in any high risky fashion.

Fact is, its highly likely that iTunes software has no such restrictions. Jon is the father of iPod, Im sure he knows better than any speculations here.
 
The fact that the Pre has to mooch off of Apple's genius program is nothing but flattering.
