Incorrect. If they sent a C & D, it would legitimize the photos/renders. By ignoring it as they have and always will do, it leaves us wondering.

I'm really excited for this new phone. I think the colored metal look is going looks awesome. I might prefer like the silver and white color scheme for the new white version, but this black metal is a nice new flavor... dig it!!

No. The analogy really has nothing to do with Nazism, but that of the allies vs. Germany of 1944. At that time Germany had many technical achievements, but it wasn't enough to keep from being defeated.

C&D letters of this type serve absolutely no purpose in the Internet age and Apple knows that.
Once posted, pictures are re-posted and cached instantaneously and there's no unringing the bell.
Even with the lost iPhone 4 Apple did nothing but demand that their property be returned to them.
 
It's not going to be called iPhone 5, it's going to be called "The Demise of iPhone". It looks ugly and dated, pretty much like a longer version of iPhone 4. It's going to be priced a la Apple, which means ridiculously overpriced. It's quite certain that it's going to come with a bunch of issues concerning performance, battery life, reception, overheating, whatever...

Apple needs to stop being so darn conservative and stubborn about everything. They also need to stop fighting all of their competition with lawsuits and all, claiming they invented everything that exists in this world and they are the only ones who should charge -or over-charge for that matter- people to use technology. It makes them really unlikeable.

What Apple should do is take notes from its competition about what it is that they do wrong and causes people to turn their back on them...

Just for the record, I'm a 3Gs user, satisfied overall with the iOS environment but pretty often feeling trapped in it, and frustrated with the slow performance of the model. The increasing number of bugs I discover gets to me. I definitely over-payed. There is no such a thing as a best value for money Apple product. Period.

Everyone hated the iphone 4 when it first came out,

but look how people love it now.,

Please stop. Degraded usability? The 4S has one of the best antenna designs on the market. Don't believe me? Take a Samsung Galaxy S2 and an iPhone 4S (both on AT&T) to a restaurant called Locale in Closter NJ. You'll find the GS2 is little more than a paperweight whereas the 4S still works like a champ.

Glad it works for you, but for me it simply doesn't.
Maybe it's because I live in Europe and networks here uses different frequencies (hope that is spelled correct) which may be harder to handle for the iPhone or it may be due to the fact, that I don't use a Bumper/Cover (too annoying to get rid of it when putting it in and taking it back out of the Carmount 5-10 times a day depending on how many Clients I visit)...
As with most issues about reception it all boils down to the combination of phone used, network subscribed to, location and some other factors...so surely your experience may be different.
On the other hand...having an antenna design that exposes the antenna to direkt skin contact is...well...at least sub optimal.

I did not read all the comments, BUT...

Did anyone else notice the inconsistencies in the volume buttons on the 'leaked' design? In some pictures the '-' (minus) volume button is facing top-to-bottom. In others, the minus volume button is facing front-to-back.

I dont see why Apple would change the direction the minus sign faces on the volume buttons. This makes you wonder how reputable these sources are. Both the plus and minus volume buttons are just one piece inside the phone, so it seems like there are a few different 'models' that people have made as fakes and they must have mistakenly mixed and matched the 'leaked' photos they put online!

Again, sorry if anyone has already noticed this! I did not feel like reading through 900-some comments
