I once received two PowerBook G4's. I sent it back though. To this day I wonder if they would have noticed. I'm glad I sent it back though, but it was super tempting.

No, you'll be doing good if you donate to charity. Apple doesn't do that.

Same thing happen to me and I called customer care. It didn't show in their system that I already upgraded to the 4s but she said once the system is updated and it shows that I received 2 phones they will charge full price for the 1 they mailed me. I was also tempted to keep the 2nd phone but will send it back.
scare tactic. i'll call bluff til charged, when charged. will send it back, should coulda woulda isnt going to work here. if im charged i'll send back, if not, well worst case is they charged.
question, say 3 months pass, no charge. but when they activate the phone, doesnt it come pregrogrammed for my #? will it set a distress becon or some alert? how does the activation process work
I don't know US law, but I'm pretty sure knowingly keeping something you haven't paid for like this is a criminal offence in the UK, as is anyone else encouraging them too. You know, with time in prison and a record and stuff.
So don't do it, it's probably illegal, and let's face it, it's not very classy, is it?
a company as big as apple will clearly know that in there database that there iPhone 4s that has a linked IMEI, will be missing and they can track this down, shut it off remotely and you have no working iPhone and billed twice, Karma's a bitch!

The saying goes that character is defined by what you do when nobody is looking. Hopefully OP has a moment of clarity and realizes how true character is worth more than a couple hundred bucks. Be a man, return the phone, and get a second job if you're short on cash.
