Are you booted to the DVD? If so, just erase the entire internal drive then install to that.

PS, you don't have a fix for when the battery won't take a charge and the power icon looks like a battery with a cross on it????
Replace the battery with a new one: https://www.ifixit.com/Guide/MacBook+Core+2+Duo+Battery+Replacement/510 Easiest battery replacement you will find. Looks like it will cost about $70. If you go to the Apple menu, About This Mac, then System Report. Select Power and see what it tells you about the battery.

Like Glen said, that sounds like a bad battery and it is time for a new one.
one thing though I tried a new battery (or at least one from another machine that charged ok) and the same icon thing came up? So in my very humble opinion its not maybe the battery after all? Any thoughts?
