PS, you don't have a fix for when the battery won't take a charge and the power icon looks like a battery with a cross on it????
Replace the battery with a new one: https://www.ifixit.com/Guide/MacBook+Core+2+Duo+Battery+Replacement/510 Easiest battery replacement you will find. Looks like it will cost about $70. If you go to the Apple menu, About This Mac, then System Report. Select Power and see what it tells you about the battery.

one thing though I tried a new battery (or at least one from another machine that charged ok) and the same icon thing came up? So in my very humble opinion its not maybe the battery after all? Any thoughts?

Suggest starting a new thread. People looking at this thread to see about "Recover Photo library from Time Capsule" stopped being relevant after post #4.
