Is it apple's fault ? Or my fault ?
Apple's fault. They had a crappy thermal design with the non-retina MBPs, and to add insult to injury, they used an inefficient chip coupled with shoddy thermal paste application along with unleaded solder (but then, everyone uses unleaded nowadays).

They'll fix it for free.

But is it okay if i sent my mcbookpro while the hard drive is new (replaced with ssd drive) not apple hard drive ?

Should be okay, but I'd just put the original hard drive back in just to be safe.
