If Samsung isn't guilty of patent infringement, they're definitely guilty of not going very far out of their way to be different. :apple:

Agreed...IMO...it's the UI that is really the big offender.

I mean couldn't you at least design something that is unique like Microsoft did with their METRO interface? You aren't going to confuse that with iOS.

The hardware bar-none obviously looks like the iPhone also...Samsung could have changed that up also...hard edges, maybe move some buttons around.

Overall...Samsung is going to lose this case big time.
 
It's the jurors I feel bad for. They are prevented from earning a living while mega-billionaires fight over what shape their plastic boxes are. I don't think I'll want to buy an Apple or Samsung product again.

I feel more bad that they have to listen to hours and hours upon days of this crap that literally no one outside of the companies themselves and people on places like MacRumors care about.
 
It's already gone on record that "crisis of design" is a common phrase over at Samsung. So it in itself is not damning.

Forbes blogging is far superior to The Verge's which sounds like it's being written by a high schooler.

And the icons which were posted here are a ridiculous proof point. The green phone icon has long been the icon of choice way before the iPhone. And in a very similar way.

There are some "universal" ways people indicate icons that has preceded Apple's 2007's iPhone. Apple may have made it ubiquitous amongst members of this forum - but they don't own the concept.

Because they were trying to copy, but they don't anymore. Just look at TouchWiz 4.0!

Funny thing: it doesn't matter whether Samsung copied Apple intentionally or not.
Patents protect against competitors "accidentally" copying intellectual property as well as intentionally copying.

And ignorance of a patent on a design isn't a defense. We'll see if Samsung tries that sleazy angle shot.

I think "willful" infringement increases the damages, though.

What part of Apple's registered trademark don't you understand. Their design is specific. Samsung's looks similar - yes - but it's not identical. Something which is key for a trademark violation. Just because you don't like it doesn't make it illegal or an infringement.

Are you telling me the green phone on an angle is new to you? My first dumb phone in 2002 had the same symbol. In green. CRAZY!

Probably lots of ways. But some are certainly better than others. No desperation. You keep insisting there is doesn't make it true.
 
I don't understand how a former APPLE designer Susan Kare could be used as an expert supposedly neutral witness. Even so, if she picked up a Samsung phone and thought it wa an iPhone she's anything BUT an expert. Jeez. :rolleyes:

In case case, if Apple wins this ridiculous lawsuit I will never buy an Apple product again. I really mean that.
 
So what? Is Apple going to ban Galaxy phones and demand Sammy pay $4 billion or what? Why should Apple get any more cash, they already have made their fair share of profits and then some!

Who gets to determine what constitutes a "fair share"? Why should Samsung be able to generate any earnings by copying someone else's work? Is that their "fair share"?

I guess if the courts rule in Samsung's favor then they will be entitled to their fair share. Right?

As Steve Jobs mentioned before it was not just about the money, he had plenty of that. He just wanted Samsung to stop copying his ideas.
