It's his problem that he's a moron. He can try all he wants to take you small claims court. And oh, next time don't give your number to someone from craigslist bc they will stalk your life.
 
Just block his number. You did use a google voice number for Craigslist transactions right? RIGHT?!
 
As long as you never led him into thinking it was unlocked, no. If there's a possibility that your wording wasn't clear or you eluded to it being activated making sound unlocked, then yes.
 
No. Here's the deal. I live on CL. Just got my iPhone 4 from there, along with many other things. I understand as should everyone who deals on it all items are as is no warranties or refunds unless otherwise stated. I believe the person was just so excited to get a 4s that they didn't bother to ask the right questions before buying it. I was beside my self when I found my phone on CL, but I still went to the Verizon store and had it checked out to make sure all was well.
His bad. Tell him to sell it on CL for what he paid for it.

Use Google Voice for CL transactions next time so you can block calls after the deal has been done fairly.

+1. I've been doing this since 2007 when I was beta testing Grand Central. As far as the transaction, he can't read. I wouldn't give him the money back. He should have asked before hand. I'm surprised he didn't being you met him in person and he didn't test it before you left.
 
Thanks for the advice fellas, I guess I will let him know that I will counter-sue for his harassment of calls he has given me the past 2 days.

You didn't ask, :) but AT&T might allow you to block his number at no charge. If they don't offer a freebee you'll have to subscribe to a service (AT&T cannot block calls where the caller "blocks" their number but third party services can). Be sure to file a police report. AT&T will also offer the helpful advice to change your phone number.
 
Thanks to this thread, I just made a google voice account. I recently started selling stuff on CL, this new number will come in handy. :D
 
I recently placed an ad up on Craigslist to sell an extra iPhone 4S AT&T model off my family upgrade plan. Buyer was generous enough to have me stop by his place and he agreed to pay me without haggling on the price. Now next day he demands a refund saying the phone was not unlocked and he thought all AT&T iPhone 4S are unlocked etc etc. He has called me 24/7 non stop requesting and refund and even threaten to sue me in small claims court. Is it my fault for not telling him the iPhone 4S was locked? Should I refund him? He even tested the phone to make sure everything turned on etc. Help please. Thanks

It is his fault that he didn't do research and bought a locked phone. I would refuse to give him the refund and tell him to sue me if he wants. As it is his fault that the bought a locked phone (as long as you didn't tell him it was a locked phone), I would say the judge would give you a favourable decision. I don't want to be giving legal advice though.

However you can give him money back minus a bit for all the issues his mistake caused you in good faith.
 
Hell no. Tell him to go to hell and change your number. You actually don't have to cause im pretty sure he'll get the idea in a couple days.
 
I say return it.

Assuming it is in the condition it was when you sold it, just take it back and sell it to someone else. Why worry that there is some guy out there that wants revenge. Who cares if it was his...it will be your headache.

No. He sold it as new, possibly unopened, and now it is used - period.

He shouldn't take it back, because now he will take a loss on it.

Restraining order is the way to go.
 
Some bad legal advise. All he needs to prove is your ad mislead him. Post up the ad verbatim.
 
Another thing to keep in mind about lawsuits is that they can be a pain in the ass, meritorious or not.
