Sold iPhone 3GS on eBay - Buyer disputes, now what?

Anyone know which is better Gazelle or Cexchange? I can get about 20 more dollars from cexchange, but I was wondering about the service on them.

My story is similar to most.
iPhone sold to 100% feedback holder. Got protection from Paypal so item shipped special delivery. 6 months later received chargeback. Special delivery number lost. I lose iPhone and £350.

Took case to police, no interest.
Took Paypal to Financial Ombudsman. Paypal returned the money to me. I put a block on the iPhone. He gains nothing.

In an effort to speed the inevitable along... I called paypal and volunteered to refund the money if this guy will send my phone back.. SO- they say I have to confirm that its the same phone and in the same condition before they'll refund the money to him..
