You should not list items as working if you have not tested it to work. Your are very correct. List it as sold for parts.

If you actually look up the listing in question you will notice that the description is rather specific.

Description: For sale is an Apple iPhone 5 16gb in black/slate!! I checked the ESN on swappa.com and it indicates that the ESN is clear and it is for Verizon meaning that it is also factory unlocked, please note I cannot guarantee that info is correct since I did not use the phone personally. Phone only is included. The phone is missing the screen and the body is slightly bent as seen in the photos. The phone still turns on and is recognized in iTunes when plugged into a computer. The phone has a clean ESN and no iCloud lock. Phone is sold as, I do not know anything else except that it is recognized in iTunes and that swappa indicates the ESN is clear and that there is no iCloud lock, no returns. Please ask any questions. Nowhere in there does he make the blanket statement "works" or "working". This is far more specific than a lot of "for parts or not working" items on eBay, which also operate under eBays rules perfectly.

As I mentioned before, the buyer bought this either with an intent to scam, or is one of the special ebay customers that read a quick title, looks at a picture, and bids/buys the item without taking the minute or so to read the brief description. Idiots like this is what makes it not worth selling on eBay (combined with eBay's ridiculous current prices).

I didn't say this specific auction stated that it works, but to include wording that you can't guarantee anything Bc u didn't use the phone just sets himself up for issues like this. Most of his others say works! In the title and some of the wording contradicts this auction. He's not consistent. He plugs it in just to see if the phone responds and then knows nothing else about the devices....which he states he can't guarantee Bc he didn't own it. Not arguing, but I can see why he has this issue.

I competely disagree. This is the reason eBay has a "for parts and not working" section. There are businesses that buy PALLETS of product and cannot feasibly test every item. This is actually the norm on eBay. "For parts or not working" literally means buy at your own risk.

It's absolutely not a contest... I am simply saying, having been a seller (more than casual, less than full fledged business) on eBay before, people will fail to read descriptions and then try and hold you accountable for it. This guy could do any number of things, as long as he sells enough items on eBay, he is going to eventually run into some person that attempts to do a charge back. It's inevitable. It is what eBay is nowadays. A buyer can be completely satisfied with their purchase and open up a case "just because". In some cases, the buyer may even win if the seller didn't document their sales properly.

As a semi side note, I would be interested in the buyer's feedback rating. My guess is that it's under 5. It almost always is...
 
Well the buyer sent the case to ebay decision yesterday and got the response today, it WAS decided in my favor. eBay's description said that it appeared the item was as described and was now changed due to an attempted repair, which the buyer stated he tried by adding new screens, etc.

The buyer had 105 feedbacks so I was surprised this happen.

The buyer received the phone over a month ago and now says the screen doesn't fully work.

The other listings say they work because to the extent I tested them they do, I don't guarantee anything anymore because of this case, most of the phones work perfectly fine but I list them for parts because if the ESN changes or iCloud becomes active I don't won't to be responsible and just sell as is instead.

So much for the ebay distractors who jumped on this thread saying you shouldn't use ebay, you won't be able to win, etc. Funny they don't seem to do the same for CL horror stories.

You might be out of luck on this one since your description does say that the phone works perfectly. But you might be ok since they took a month to open a case, I'm not sure exactly how long ebay gives buyers to open a case. It does seem a bit strange that they wouldn't open one right away if the screen really didn't work though.

Yeah I think the only thing I have going for me on this one is the time. I mean a month is a long time they could have dropped the phone, if it really didn't work I wouldn't wait a month.

Typical buyer scam, or he's extremely stupid. Most likely both.

As long as you can prove you stated in the description there was no screen, you'll be fine.
 
eBay customers are pretty nuts. I had one the other day who was mad at my company because eBay canceled their order before they even sent it to us. They were pretty insistent that we were going to refund them the money that we never received too. Bunch of kooks.
 
So I recently sold an iPhone on ebay and it was missing the screen, I listed it for parts/repair and said I don't know the history since I bought it in a lot. The phone was also slightly bent which I stated. Now the buyer has had the item over 3 weeks and opened a case saying the screen doesn't work.

Certinally you posted images in the auction showing the phone with no screen. If not then you might be hanging.:eek:

We know from an older thread that ebay allows buyers to open a case/contact the seller beyond the 30 day cutoff with the understanding that they won't fall under ebay buyer protection. They can open a case to see if the seller would be willing to offer any concession but ebay won't protect them.

Hope this is true, item was paid for on Feb 14, shipped on the 15th and delivered on the 18th, the case was opened on March 19th so pretty much exactly 30 days later, if they let me know right away there was a problem I would have refunded them but they have had the phone for a whole month, they could have dropped it or something and it stopped working and now they want their money back and I get a broken phone.

If I remember correctly eBay TOS says 45 days from the date of payment. I've personally had people wait until day 42 and claim the item was never received. Idiots. I always follow up once Fedex says the package was delivered. I send multiple follow ups to these people and they never responded but it proves they knew the item should have been delivered and start looking out for it.

Both claims were denied by ebay but it was annoying my paypal account was help hostage for a few days each time.

I have a case open with Ebay at the moment and the seller has agreed to do a full refund and has been very apologetic. However, he tell me he cannot do a refund unless I close the case since the funds are tied up. Is this normal?

I don't see why he would need for you to close the case to issue you a refund.

Do not close the case. This will only work to the sellers advantage. He is trying to deceive you. If you close the case, it looks like you are satisfied with the results of the case. The case is then closed and can not be re-opened.

Make him refund you first.

Paypal will make him return it to you, him paying for shipping. Once you get it and confirm it's your phone, give the money back. Simple.

Ebay ending up deciding in my favor, they stated the same thing as me that too much time has past for something that was supposedly broken upon arrival
