Just as an update...

I just got out of a very long meeting with my attorney, and it turns out I have a huge wiretapping case on my hands. And, the situation seems to now be a federal case because the images obtained crossed state lines because (among other reasons) they were being hosted on a server outside of my home state. Just so glad that the person that helped me restore the phone backed up and saved all incriminating information located on the phone prior to the restore! So again, as a warning...keep your phone in your own hands unless you 1000% the person "helping" you.

On another note, I'm very surprised that no one on this forum even knew that such a program existed. I surely didn't know, but to be told that a hack such as what I experienced has never been done is amazing, considering the volume of people that have viewed this thread. All you have to do is Google the topic of iPhone Spyware and you will be instantly informed. I mean, c'mon...spyware even exists for the Droid, lol, which came out so much later than the iPhone. So, stay safe everyone!

Glad you got things taken care of. If you have access to the device for any period of time, like that guy did, you can gain permenant access. Heck, I could write a script that would let me remotely access a jailbroken iPhone from anywhere in the world in 10 minutes. I'd be really simple actually. It's not a matter of the fact that jailbroken phones are risky, it's that letting someone have your phone for that long is risky.

And what I'm referring to would be all done in shell scripts that any CS major (I was only a CS minor) would know.

I was just checking to make sure that you're not experiencing any more issues. Because some things you install on a jailbroken phone will still be on the phone if you restore your phone. You need to do a restore and set up as new (not use a backup) to ensure that it's clean.

Cool man, thanks for the insight. The phone was restored to factory settings, and not restored from the backup. Since then, I have not encountered any more random beeps, screen lighting up by itself or anything else unusual...AND, my battery life seems to be lasting longer and I'm getting a stronger WiFi signal within my home for some reason. The whole situation is just an unsettling feeling - just to know that MMS messages were intercepted and posted online is unreal to me. I was living in a shell I guess, not thinking that could happen to me. Now I really can't imagine being a victim of identity theft - this was bad enough.

It's just funny that the guy that did this to me should be at work (at a MAC Store nonetheless)...but yet it appears that he's been online since this whole situation was figured out and I discovered who it was. Even more funny, when I try and message him he won't respond, lol. I even took a pic of my girl holding a sign with a nice little message to him and texted it to my other cell phone, just in case he was still intercepting the texts - and about 5 minutes after that is when he appeared online, and has been on ever since. A little late to be covering tracks, I'd say!

So do you think he is still intercepting? Since he popped online?

No, I don't think he is accessing anything any longer. The phone is running SO much faster, battery life is lasting longer and overall just seems like a new phone again. No more random beeps or screen lighting up - so I think I'm in the clear. I'm just glad he screwed up and I noticed he had been lazy and posted one photo that I had never texted which was on my photo roll, and posted one that I had only text to one very, very close person (a former RealWorld castmember actually, lol)! But yeah, he's still online and has been pretty much since 5am. Just anxious to serve him with some papers ASAP!
 
Hey there, I'm not sure about the upgrade making sense...but it was the first generation iPhone, and now it is version 3.0.

The thing is, he posted pictures he had while the phone was in his possesion, AND photos that were taken up to a week ago (he did the upgrade October 2009). There are even pictures that I took after the Yankees won the world series of me in a Yankee hat, and never sent them out to a single person. He is somehow getting photos directly from my phone, whether they are sent out or not. He is literally a computer genius, getting his doctorate in pure mathematics, and minored in astrophysics just because it was fun, lol. Maybe I have stumbled upon something new, but was hoping someone had heard of this before. Thanks for the tip though...I'll definately be wiping out this phone and starting over.

He'll get what he deserves alright, without question. The phone is back in awesome condition, and that dude works for a Mac Store & has interned as a school teacher. I have time, money and a kickass lawyer...so he's in for a sh*t storm, lol! I love your train of thought bro!

I gotta say, I had my doubts when you first posted, I would have guessed you were affiliated with the said app at hand. But, to see how it has progressed, I don't see how this would be beneficial.

I'm glad you got a backup before it was restored, I cringed when you said you wiped it clean until you added it was backed up. That's why I was trying pointing you in the direction of finding the app on your phone. Obviously, you need proof for any legal action and it sounds like you may be on your way to getting that proof.

It takes 62 characters to send your pics to another computer. (<--that was 62 characters). And 32 of those characters are the location of the pics on your phone, so the path to the photos is actually longer than the command to transfer them. It could be set up to run daily on it's own, named anything, hidden anywhere, or tucked away in another script or program and run when it runs.

Hmmm, I actually know the perfect place. Can I borrow your phone?
 
Did you give him your Apple ID user name and password and your ICloud user name and password when he was working on it? If so you really need to at least change the password. No amount of restoring will help if he has that info he can still get your photos through photo stream.
