Subpoena Asurion records

This is COMPLETELY FALSE! In no state in the US is that true. Do you know why?

Geez you people don't even understand basic, basic, basic things about the US legal system. Unbelievable how ignorant you are.

You are ALWAYS entitled to representation by an attorney. ALWAYS. Now you have to pay for it unless you are indigent and being charged with a crime. But as long as you can pay for an attorney, the attorney can represent you in court. IN ALL COURTS IN THE US WITHOUT EXCEPTION THAT IS TRUE.

False again, it is as expensive or as cheap as the case warrants given not the amount in controversy but the amount of discovery needed and the number of witnesses needed. But whether or not it makes sense to pursue an expensive case when the damages are low is another issue altogether. The amount of damages don't determine the cost of litigation - the facts of the case do.

Watch out, we got ourselves an attorney here. Its a small claim court because of the value involved, DNA test? Pathetic, who is gonna do DNA tests and all that crud in a 600 dollar damages case? Get real man.

Also, in state of Washington, no attorneys allowed in a small claims court. To touch on the constitution and the attorney representation, i think you are confusing when someone is charged in a criminal or civil court is entitled to an attoreny and a trial by the jury of his peers. This here is neither and your belittleling attitude is not welcomed. How old are you anyway. No need to humiliate people if they are incorrect on things. There no criminal charges here so.

Did you friend have the opportunity to visually inspect the phone? Did the seller afford him the opportunity to test it (e.g., insert a SIM, etc.)? Did he explicitly deny your friend the opportunity? How obvious are the marks? Does the phone function as advertised?

Reminds me of a local car dealer that has ad in the newspaper. Describes the car in mint condition, with low miles. Buyer arrives and closes a deal. He later complains about the 75k miles and the wear and tear on the seats and the grime on the engine. Fact is, the buyer had the chance to inspect the car before purchase.

The guy is delusional. The case will be tossed into the heap. Paying for a device thats presented to you implies that you are happy with what you saw. If you did not inspect it, its on you.

I checked my service agreement with Asurion. They do not claim to send brand new phones. In the service agreement they specifically state they may send brand new or reconditioned phones. If the send reconditioned phones they may use non-OEM parts.

1. If the seller said it was brand new, it was sellers interpretation. I dealt with Asurion in the past and they send "warranty replacements". No nomenclature on the status.
2. Are you sure the email came from Asurion? Was the email sent specifically to seller? Was it spoofed? Was it faked?

If the email is indeed legit and was a warranty replacement by seller, and you know who seller is...seller should contact Asurion and see about getting a replacement.

The real idiot is someone looking for legal information on thread, someone that can't understand a basic principle as caveat emptor, someone thinking he can get DNA from a phone to use in small claims court.
 
The other thing your friend can do is call that registered agent in the link I posted above and ask them if they are the proper registered agent for serving asurion a subpoena wrt it's cell phone insurance services. They are a professional registered agent corporation and Asurion is a legitimate company so they aren't going to lie to someone.

Jules - I have the information needed to contact Asurion. But will contact the redg agent as well just to verify. Will PM you the details that I got from Asurion so that people trolling the thread will not be able to provide irrelevant responses. and please remember - "stop responding to clueless folks"

Really, because Jules is the one who was talking about DNA samples and nonsense of the highest order and misunderstanding the constitution. He is the meaningful contributor? Also the guy who made personal attacks at members?

I get that you're looking for info to contact Asurion. Why isn't ok for others to pose questions for you (like the ones I posted above)? You are so dead set on the "fact" that your colleague was wronged that you're not keeping an open mind to accept feedback from others who are identifying potential difficulties you might have in getting justice. No harm intended. Why can't you accept it for what it is?

I was debating whether to respond or not because I'm sure your 'colleagues' might jump in and take away the objective of the thread. However, I decided to respond this time and see.

Since your question was why others cannot question me - I'd suggest that you go over this thread again. I was asked plenty of 'relevant' questions and have provided answers to those. However 'irrelevant' questions are not something that I feel I have to respond to. Just see my posts if you want and you'll see what I'm trying to convey here.

As far as feedback from others is concerned - Again it goes back to 'relevance' and the fact that most feedback had nothing to do with the topic in question. I've responded to Jules simply because his posts mentioned something relevant. Mw0103 posted only a couple of times and in both instances corrected the posters and that was enough for me to see that he knew this subject. Rest was all noise.

But it was fun and illumating, wasn't it?
