Actually, there was a specific case where Herman Miller sued an Australian furniture company Matt Blatt for using their Eames Designs. The verdict: They settled, and all Matt Blatt had to do is to use the word "replica" when they describe their Eames and other 20th century design that they copy exactly. You can go to Matt Blatt website and they still carry Eames Lounge Chairs etc...

I don't think Apple won against Samsung on the beveled icons alone, it was other interactions that they "patented". That carries more value in the courts.

In reply to your comments about copying your clock design, let me remind you that your clock does not have any Data Plan contract attached to it, it has no apps, no wi-Fi, no LTE network, no storage capacity. As a matter of fact, it doesn't even have the capability to be jailbroken. Therefore, it is the peoples and Apple's understanding that no copy right laws were infringed.

Since Apple could patent a rectangle with round corners, this is an open and shut case.

Um, don't be foolish. Apple is in a completely different industry. If Apple were to make clocks, it might be an issue.

No doubt this is an oversight that I'd hope Apple will fix. Samsung, otoh, went all the way to trial in their deliberate attempts to copy. So hardly the same thing at all.
 
Sadly so true... iOS 6 maps data for Switzed is abysmal!

It's funny... I also immediately noticed the design resemblance, only thing it doesn't replicate is the short pause the seconds ticker marks before moving the minutes hand, but other than that this design is quite famous and a mark of pride for the Swiss Federal Rail Service (every single station has these on each track).

There are differences it is not an exact copy. However you would think, if this is actually what inspired Apple then out of courtesy they would contact the copyright holder and explain what they intend to do. A little courtesy goes along way.

It is an iconic design, such are Apples. There's too far little communication between coorporations
 
They look different to me. And I actually think the Swiss railway clock face is more attractive, with better weightings of the hands and tick marks.
 
It is sad, Swiss Federal Railway now will have to pay for every hour of clock used on every single station and media, depending on how much profit each station has.:rolleyes:
 
There seem to be some real Apple haters in this thread (despite their lurking on an APPLE forum and having many posts) and people also defending Apple.

Simple fact is that Apple DID copy this iconic design and are in breach of copy-write as the design is still owned. You can call it homage or whatever you like but it's still a copy of an in-use design so it will need to be changed or paid for.
 
In Germany, Switzerland and Austria all trainstations have the same clocks. So whats the deal? :confused:

I think they are different enough to not need licensing.

The small hash marks are longer on the Apple version.
The hour hand is thicker than the minute hand on the Swiss version.
The second hand is longer on the Swiss version.
The minute hand is longer on the Swiss version.
The hour hand is longer on the Swiss version.
There is no logo on the Apple version.

You have GOT to be kidding. Did you measure them to try and justify apple?
