I'm going to try to get a replacement. If I'm spending near $400 (32 gig plus tax in California is nearly 400), I want it to be perfect with no defects. No doubt I will most likely get a case anyways, but that should be my choice, not a requirement. If it were a requirement, it should have come with the device itself.
