I dont find the example flawed, both sides you've got people saying "Well just be careful!" or "Just don't drop it/crash your bike".

Both of these things are often unavoidable at the moment it happens, there have been times where I've been holding my phone and texting on it, I'm not carrying anything else, I'm not walking, I'm just standing still and texting, and I have suddenly lost my grip on the phone. Also what if someone bumps into me and I drop my phone? That has happened to me before.

Exactly. Or if you're carrying a bunch of other stuff with the phone, and you lose grip on some of it, and the phone goes flying.
 
You can't just say "be more careful"

I agree with this to be honest - it's not as black and white as simply not being careful enough. I don't use a case for my phone and aim to be incredibly careful with it instead. You can be as careful as you want though, but accidents/the unexpected will still happen. For example, my phone was stolen from my pocket of all places this week.

Driving's another example. I would consider myself a pretty safe driver. I try my hardest to compensate for other people's stupidity (in London, you have to), but there's still the possibility of being caught in the wrong place at the wrong time one day.
