What's funny is it's getting advertising front and central on iTunes as well!

Looks like the film co. should get in trouble for this, though, not Apple. I doubt Apple is doing a search for copyright infringement.
ya i saw that too, Apple's really trying to rake in as much money as they can of TPS it seems at this point :p . On a serious note, i think it is wrong to do that. Why does it matter how big of a video it was or not, the fact is Apple flat out copied them. They honestly are lacking that much creativity at this point that they can't make anything different? sheesh.

It just seems like Apple is really developing a superiority complex. They referred to PCs as "dull little boxes" without consent from Intel. They created a strikingly similar commercial to the Postal Service's music video without consent or any effort to inform the band.
Compare these for me; which one is dull?

The question is, did Apple really copy them. And if they did, whose really did the copying, Apple, or the director.

In my opinion if you feel it is a "direct copy," it was the directors fault. Apple didn't go through the music video and say; "give us that scene, and that scene, but leave that scene out." -The director made those decisions.

there's a fair number of good-looking PCs out there - me personally, i have an antec sonata case for one of my desktops, gorgeous black.

lian-li makes cool aluminum cases too.

So really, its just dull if you use that stereotype. Then again, Apple's older computers were dull too. Nowadays most computers come in more than just beige :p     (personally, i really despise white, would love to repaint my iBook case so it's like translucent silver or something)

as for the ad, don't see why ben gibbard is flipping out. i'm not a fan of such great heights (good, but waaaaaaaaaay overplayed), but i'm a huge fan of dcfc. i think it's just more publicity for them :)

It's true, that may have been an unfair comparison (I googled "ugly PC" to get that pic) :p

And I know some PC's do look good, but most people seem to think that adding lights and making your PC look like something from star trek is cool. example of an over-done PC: images.jpg

I prefer the Apple cases that are designed for elegance & simplicity.

It's one thing to have a well designed case; and it's another thing to have a case that has no real purpose other than to glow. (like the one above)

Sure, it's obvious which company is superior; we all know that. But there are just certain codes of respect that companies/people should follow. Do you treat mentally ill people like dogs just because you know that you're smarter than them?
I know what you are saying. It wouldn't be proper for Toyota to badmouth Ford in a commercial. But lets just remember the company Apple is badmouthing; Microsoft - the company that has broken every law in the book.

Some things are well deserved.

well, i don't have case lights for mine, nor a window. just the way it came after i bought it.

And you say that Microsoft's broken every law in the book so confidently ...as if Apple hasn't done its fair share of outrageous, stupid and borderline illegal things?  :D

It's much more than subtle similarities! That's why TPS (The Postal Service) is none too happy about it.
So... you guys missed the part where the ad agency hired a director who is the one who's idea it was. The same guy who directed the other video. Not saying it's right, but I can't say I blame Apple or Chiat/Day if they knew nothing about it. Which I somehow doubt they did. If they knew it was so similar to the video, and the band owned the rights to it, they would have compensated or at least warned the band first so they wouldn't get sued.

Since no one is getting sued, I'll bet the band is more angry at the director for reusing the same idea and disappointed at Apple for not realizing it.

But, Apple can do no wrong. ;) :p

BTW - Your PC case is nice. It looks perfectly fine, and yet isn't releasing a bluish glow. Other PC users need to figure out these two things (like you have):
1. Just because it's not glowing, doesn't mean it's not good.
2. You don't have to change anything once you buy it, you can just leave it that way.

Who Owns the Footage?

The question remains as to who owns the footage? This is very likely that the Intel Factory video is owned by the director. The director owns the rights and can sell it to any one that is willing to pay him. This is known as "Stock Photography". It is very common for one company to buy a photo and use it in an ad only for it to turn up somewhere else.

It is also the responsibility of the buyer of the photo to secure exclusive rights to the photo/clip. This means that no one else can use the photo without their permission. Chances are the Postal Service did not pay for exclusive rights,

It is the responsibility of the rights owner to disclose all uses of the art in question in order to ensure there are no conflicts.

A famous example was the Everywhere Girl. The Everywhere Girl (also known as The Stock Photo Girl) is a model, identity unknown, who frequently appears on advertising material for a multitude of companies around the world. She has been featured in Dell and Gateway ads, promotional material for universities, etc. This repeated use of the same photos is an example of stock photography: a photo stock agency owns the photo set and sells exclusive or non-exclusive right to use the images. The images of the everywhere girl are owned by Getty Images, and are obviously being licensed for non-exclusive use. The photographer has been credited as Doug Menuez and the location is reported as Reed College in Portland, Oregon.
