If, IF this is really not an Apple PR stunt, some people at Gizmodo aren't going to get much sleep for a long time.

Either way, someone is going to lose with me. If it's an Apple PR stunt then they have just diminished me as a loyal consumer. If it's not, well I've already deleted my Gizmodo bookmark.

EXAMPLE OF "LOST" TURNING INTO "STOLEN":
Person finds property that does not belong to them (unreleased iPhone), can CLEARLY identify the owner (Apple - really big metallic logo on the back), makes no SERIOUS attempt to return the property (waiting around in a bar for the person who lost it to return), DOES NOT attempt to turn it over to legal authorities, SELLS the UNRELEASED item for a PROFIT. That constitutes THEFT.
 
Gizmodo didn't report on anything. They participated in a crime!

I hope everyone involved gets fired and Gizmodo gets closed down for good.

They're not consumers they bought stolen property and they knew it.

If this whole thing really happened the way it’s being reported, Apple had over a month to report the phone “stolen.” The last time I checked, it’s pretty hard to charge someone with receiving stolen property if the property is not in fact reported stolen. So instead of reporting the phone as stolen, Apple sent an email asking for it back.

Furthermore, one of the elements to receiving stolen property is that he INTENDS to permanently deprive the owner of the property. GIZ clearly returned the property immediately upon request by it's owner.

Again I do not believe we have the entire story, but as it’s reported now I just don’t think any of this meets the elements of any crime.

Apple could have never pulled this one on Pogue or Mossberg. Apple needs idiots like Denton to help stir up the fanboys.

The Gizmodo guys couldn't even recognize a flippin' EMI shield. Either they are complicit puppets or they are genuine morons, but nobody from Gawker Media can claim expertise on anything.

Let's face it: in a couple of months, the Gizmodo guys will be invited to whatever Apple media event happens and we'll all look back and say, "gee, was it worth Apple to leak a little controlled information for a $2 billion increase in market capitalization?" Fine, so Gawker Media got a couple million pageviews. Good investment or bad?

Note: Apple just announced the best non-holiday quarter on record, one in which they announced no new product. You think the lack to blockbuster news really hurts Apple? Yeah, I thought so.
 
Some info about the battery

I should state this, but can anyone guess how many iPhones have come into one of the busiest Apple Stores in the US in the last 6 months because of a battery issue?

It appears that the batteries in the iPhone outlasts the iPhone itself.

I vote we keep the battery in the iPhone just as it is.
 
Or Apple is trying to throw people off by sending the "Please let me know where to pick up the unit" letter if it wasn't that important or it was done on purpose.
In two weeks, no one will remember which news organization "leaked" the iPhone prototype. Joe Consumer will only remember that it was the Apple iPhone that got "leaked".

Heck, if you put the defunct "ThinkSecret" in a poll of who leaked it, they'd probably get 10-15% of the vote.

Gawker Media (and Nick Denton) got played.

Do you honestly think that Apple does not have the capability to track lost equipment? Hell, I can do it today with Mobile Me.

How many iPads were out it the wild a month ago. Did any of those "get lost".

We knew who had them and knew where they were at all times.

I just can't believe that people here are so stupid, that they believe this story.
 
When Gizmodo returned the iPhone to Apple, I wonder if they handed them a plastic baggy with a 50 pieces in it. :)
I'm sure Apple would not have been very delighted.

What if that was the ONLY iPhone, and if it was never returned, the general public would have to wait another 12 months!!!! :eek::eek::eek::eek:

Frankly, although the speculation is entertaining WE DON'T KNOW ANYTHING.

Infact just about the only thing we do know is that this was an Apple product.

We don't know how much like the final version this thing is, whether it was a publicity stunt, how old the device is, whether it was stolen or planted, whether Gizmodo actually paid for it, whether the final version will have a removable battery or not, whether this was simply a prototype or not, what processor it will use, how much RAM it'll have, specs of the camera, whether Gizmodo were in the wrong for 'buying' it, whether this 'prototype' will bear much resemblance to the finished article...etc...etc...

The only other thing we can be reasonably certain of is that Apple will be delivering a new phone this Summer that will address many of the things we want to see in the next iteration.

On one hand Apple is very secretive etc, and this might have overshadowed their launch for which they usually get a lot of press for. It might have a negative impact on current sales. It might have taken some of the panache out of the keynote.
On the other hand we are all rooting for the new one after seeing this, there has been loads of interest and I'd bet there are fewer people thinking of getting an android phone before this thing comes out. It's also a pretty nice focus group for Apple to look through.

I'm not surprised by either of these theories - both plausible. I don't know. I'm just glad it's going to be a great upgrade, and I will be first in the queue when it comes out after seeing this...! ;)

And yeh, yeh, I know this is a rumours site...

True, lucky(?) for me I live in UK so I don't have the whole AT&T crap to deal with.

UNLESS, of course, the true OWNER can be easily identified by the identiying factors on the item. If I found your wallet with a driver's license in it, and decided to NOT return it, even though I KNEW it was yours, I would be guilty of THEFT. An UNRELEASED (not publicly known) product, with CLEAR Apple Identifiers (Apple logo, trademarked iPhone name, etc.) on it, makes it just as EASY to identify the OWNER as a driver's license in a wallet. Contacting Apple is as simple as a phone call or e-mail.

Gizmodo may have returned it AFTER a formal request was made, but, as I have said in earlier posts, they purchased it KNOWING that the person selling it to them DID NOT own it (as it was an unreleased Apple-ID'd item) and therefore entered into an ILLEGAL action identified as THEFT.

If Apple and Giz set this up as a hype-machine, then Giz will be in the clear. If they did not, the possibility exists that Giz could face civil and/or criminal charges if Apple decides to pursue them.

FINALLY, in your comment concerning the "PERMANENT" nature of the taking, I suppose that means if I take your car without your permission and use it for a while, but all the while have the intention of returning it to you at some point, that does not constitute Grand Theft Auto? Guess you need to read up on the law. Let me assure you, "borrowing" something without the owners permission for ANY PERIOD of time, constitutes THEFT if the owner of the property decides to press charges against the "borrower".

So you're putting your faith of news coverage into Gizmodo because they say it's all true? How do you know what accuracy is when Gizdumo isn't even a reliable news source?

As you will notice, no major news agencies (CNN, Wall Street Journal) have even bothered picking up the story.


I love all of this coverage on the new iPhone. Gizmodo did the right thing by REPORTING the news accurately. I'm so happy I didn't waste my upgrade on a 3GS when this little gem is right around the corner! So excited to pick one up, I love the new design, front facing camera for video chatting! I sure hope someone takes off that metal to find out if it has a A4!!

I really don't see why everyone is hating gizmodo for taking the product apart, don't you want to know what's inside? Power to the consumer I say, the more we know the better. I don't know about you but im a fan of complete transparency.

Seams on the aluminum...

I'm surprised no one pointed this out yet. It looks like those seams/gaps on the metal have rubber (or black plastic) and aren't really gaps. Look closely at the tear down pics. I cod be wrong though.

Maybe those gaps or rubber parts are to help the reception?

What still bother me is the whole apple sleeping with att.

I wouldn't be at all surprised by a Verizon phone this year though. It's all about adoption and market share now Google are on the scene. It's entirely possible as far as I can guess.
