Last month I got my throttling warning at 11 gigs. This month I am at 3.8 and I got the warning. Also, last month I started using "Tether" app that was available on the iTunes store for a day before it was removed. The day after I used it I got the warning last month. I used it again Saturday for the first time this billing cycle and Sunday I got the warning again. I'm convinced this is not a coincidence.

You probably went from < 2GB to 11GB while you were tethering. If you're streaming any media, downloading, or even playing online games over tether, it will chew through a lot of data quickly.

Keep the thread alive, and keep calling AT&T. I got the notice a few days ago at 3.8 gigs, not throttled yet and my billing cycle doesn't roll over until March 2nd.

Yes, as most of us have known from the beginning, this is just a scam by ATT to get you into a plan where they can collect overage fees.

All of you pro ATT people out their saying "you unlimited data hogs are ruining the network" are all just filling up on ATT koolaide.

Yes it is. They are just being a bunch of pricks! ATT should stop their data throttling. However since it's been going on for some months I seriously doubt they will. Every provider has it's pros and cons.

Conversely, that same data could be used to promote AT&T's side as well.

It doesn't matter who is using more or less data or what they're paying for it.

The networks are over-saturated and AT&T is doing what it can to ease it's burden.... by throttling those it can. They can't stop someone who's paying for 5GB to stop using that much, but they can alleviate some of the system's stress by limiting those on unlimited plans.

Until the internal memo saying that they're simply doing this to get people off of unlimited data, to make more money, and that it has no bearing whatsoever on the network, nothing else matters.

If you don't like it, speak with your money and go elsewhere. There are other options.

Sure some throttling is understandable, but when they reduce your speed from 7 Mb/s to .1 Mb/s that seems a little extreme to me. Maybe if they reduced it at a slower rate it would seem more fair.

I states earlier that reducing by 1/2 or even down to 30% would still leave you with an effective phone. But they pull about 98% of your speed away.

The worst part is they cant even give you a consistent non throttled speed. It can run from .256 to 7. or more. So they can not deliver a consistent speed and they throttle down to nothing. Get rid of them as soon as you can.

Unfortunately, they need to throttle it back so hard.
If they didn't, the highest data use culprits (like streaming video) would continue to work fine.

HA! to all of you people who wanted to argue with me that ATT can do whatever they want. "its in the contract". You guys wimper around your whole life taking whatever anyone gives you, I would prefer to stand up for my rights just as that person did.

Its much worst to whimper and cower through life than to loose a few fights, hey you just might win a few also.

I am in the same court district, I think a trip to small claims may be in order :)

From the article:
When AT&T (NYSE: T) started slowing down the data service for his iPhone, Matt Spaccarelli, an unemployed truck driver and student, took the country's largest telecommunications company to small claims court. And won.

It's good that an unemployed truck driver has the money to pay for an expensive iPhone plan along with the time to go to small claims over this. America is an awesome place, isn't it?

Anyway, this is going to get worse before it gets better, and will likely end in terminating the unlimited option all together, and giving those who currently have the unlimited plan the ability to cancel contract sans ETF. That's my guess.

Ventura Country?

They will probably kill the unlimited come the next iPhone. Why stop collecting money if someone won't complain.

The dude who won the $850 AT&T throttling case even admitted to illegally tethering last year with his iPhone to his iPad.

Man. If he won the case. I am sure there will be a flood of users who have too much time on their hands and start suing AT&T in small claims court.

If enough people sue I am sure the national media will take notice.

Than AT&T has a pr nightmare. AT&T will have to answer the question why some people paying the $30 unlimited data get unusable speeds at around 2.1gb by throttling while same using paying $30 gets full Internet speed at 2.5gb.

That's the whole point. AT&T isn't providing the same service. If they throttled at 3gb for all unlimited users than AT&T wouldn't have a pr problem.

As it stands now only some areas get throttled after 2gb.

As the case showed even if they start at 3Gigs they still have a problem. They sold unlimited, so until they end that it is supposed to be unlimited.

If I sell you X, then try to deliver Y, then I am in breach.

Tmobile USA has advertised "unlimited data" for past 18-24 months but clearly stated they would throttle after 2-5gb depending on plan.

AT&T just needs to be clearier. Right now unlimited users don't know when they will be throttled.

Or do what Verizon does. Throttle at peak times.

AT&T has not done a good job coming up with a fair resolution to the unlimited data mess.

Well Im right next door in Santa Barbara, Ventura is only 30 mins away.

I grew up in Moorpark and spent a lot of time in SB. Our favorite beaches! We were looking to get married there this summer, but decided on San Luis Obispo instead.

Depends on what the courts rule IMO. If the courts rule that they NEED to give unlimited to those that have unlimited, they can likely just say that they will allow all of those people out of contract. The irony here is people had the chance when ATT first announced throttling, and didn't take it.

The worst is I continued with AT&T when I got the 4s for the unlimited data. Now I am stuck with a phone that isn't as reliable as on Verizon, and is SIM Locked unlike Verizon.

Oh well, at least I can do voice and data at the same time when I can get signal to work decently.

But how do you tell?

I dont think it is fair for them to throttle my unlimited plan when they can not guarntee me a base level of speed.

I mean if they can always get me 7Mbs down, and then they throttle me to 2.5 down after 7 gigs, thats fair. maybe, a little, no, its still not fair. Unlimited is Unlimited!!ARGH!

Usually they will notify you via text message.

Of course, with enough info you could use inferential statistics.
