Transgender Men Go Topless at Delaware Beach -- and Police Can't Do a Thing

REHOBOTH BEACH, Del. -- Rehoboth Beach in Delaware isn't a topless beach -- but a few transgender men caused a stir by treating it like one.

Police say passers-by complained after the men removed their tops and revealed their surgically enhanced breasts over Memorial Day weekend. A lifeguard asked them to put their tops back on. The men initially refused, but covered up before police arrived.

Even if they hadn't, though, Police Chief Keith Banks notes the men were doing nothing illegal. Since they have male genitalia, they can't be charged with indecent exposure for showing their breasts. Banks says there's no need for a specific law to address the issue.

Rehoboth Beach commissioner Kathy McGuiness isn't so sure. She says the matter will be discussed at a town hall meeting next week.
 
The fact that is actually illegal for a woman to remove her top on a beach anywhere is silly. Get over beach nudity society. Its an appropriate place for it.
 
If police want to start enforcing this, they're going to have their hands full.

I shudder at the thought of all the moobs I've seen while on public beaches. ;)
 
If any law ought to be on the books, it's one to cover up moobs.

jeez...whoever thinks its right that ANY man walk around with his shirt off no matter what shape they are in needs to have their head examined.

Delaware's only congressman is a Republican.

Very true, but their Governor, Attorney General, Treasurer, both U.S. Senators and the vast majority of both houses of the state legislature are Democrats. The Dems have also carried the state in the last five presidential elections.

More likely, those laws were on the books long before the Christian fringe co-opted the Republican Party.

also there is this myth that topless women at beaches are only for older females that wouldnt appear in Victoria Secret catalogues.

Quite the contrary. Usually they are 25-35 and quite attractive. Most are international though. very few, if any, americans go topless.

Obviously because tourism brings life to Miami beach... however, I don't think some cops mind looking either(?)

seriously though, america needs to kind of drop the whole "boobs are to be covered up" thing

i remember one time in las vegas, a foreign lady (i believe she was speaking italian?) had removed her top and very casually put on another top without batting an eye

but the groans i heard from the women and the hushed awes from the men set in my mind confusion as to why we hold sweater cows to such a different standard

besides, it all really matters what's between your legs, at least that's what I think
