Sounds like someone needs to go take business economics 101 class again.
Not to mention the contract they signed when becoming a retailer that selling early like this violates.
I don't even understand the points these guys are making. Products have release days. Manufacturers get products to shops ahead of the release day to make sure they're in stock ... on release day. In the alternative they're proposing, where shops can sell something just because they have it in, Apple would just ensure that no shops received stock until it was officially on sale, which would cause even more supply constraints.
