according to apple and at&t's website, you can only have the iphone shipped to the billing address on the account. This is a problem for me since I'm not the primary name on the account and i live hundreds of miles away from the billing address...
 
I am indeed an existing member, and my mother is the primary account holder and I'm just one of the lines of the family plan, therefore I don't know if it is existent to create an account

Go to att.com and sign up for an account. You might have to get your mom to give you some of her information to do so. But when you get that set up, you'll want to look for the option to make yourself an "authorized user." This will enable you to go into an AT&T store and buy a phone, change your plan, etc. without your mom being present.

what about if you order it off apple for home delivery and not att

I haven't ordered from Apple before, but I imagine you'll have it shipped to your house no problem. When you go to activate it through iTunes you will have to put in your account information to select your plan and all that jazz. Not exactly sure how it works, but I don't think you'll have a problem if you're not the "primary name" on the account since you're not talking face to face with anyone -- you're simply typing in account information and selecting options.
